William Ennalls we have Received and because we will have those things which in Our Said Court
are Rightly done and acknowledged Should be brought to a due Execution Command you
you that by good and Lawfull men of your Bailywick you make Known unto the Said Nehemiah
Nicholson that he be and appear before the Justices of Our County Court to be held at Dividing
Creek the third tuesday of march next to shew Cause if any for himselfe he hath to say why the
afd William Ennalls his Execution of the Judgm.t afd according to the acknowledgm.t and form
of the Recovery afd he Ought not to have if to him it shall seem meete and have you then and there
the Names of those by whom you make ye same Known and this Writt Wittness Samuel Hopkins
Gentleman Chiefe Justice of our Said Court the 11.th day of December in the Ninth Year of Our
Dominion &c    ann Dom 1724            (F Allen)                                    Thomas Hayward Cler

             Att which said third tuesday of march to witt the sixteenth day of the same month ann
Dom One thousand seven hundred and twentyt four being the day of the Return of the said Writt Cometh
the said William Ennalls by his attorney afd and the Sherr of Somersett County to whom the foregoeing
Writt was directed ^likewise Cometh^ and maketh Return thereof to the Court here Endorsed in these words following viz.t

                   By virtue of the within Writt to me directed to the Worshipfull Lordships Justices within
Mentioned I humbly Certifie that on the fifteenth day of march Instant I have made Known unto
the within Named Nehemiah Nicholson that he be and appear before the Justices within Named at the
time and place within mentioned to shew Caus why William Ennalls within Named Execution of the
Judgm.t within Mentioned Ought not to have if to him it seems meet before Williall White and Jos
Dashiel good and Lawfull men of my Baylywick as by the within Writt I am Commanded so answers

             Whereupon the said William Ennalls by his attorny afd prays that the said Nehemiah Nicholson
to his writt Scire facias afd may answer Butt the said Nehemiah Nicholson altho' Solemnly Called
Cometh not nor shews Cause why &c but makes default whereby the said plft Remains against
the afd deft thereof undefended &c
                                                                  Therefore it is Considered by the Court here the sixteenth
day of March ann Dom One thousand seven hundred & twenty four afd that the said William Ennalls
have Execution against the afd Nehemiah Nicholson of the Judgm.t afd as well for the sum of Ninteen
pounds five shillings and seven pence Curr.t money Certain damages as also the Sum of three hundred
and sixty pounds of tobacco Costs of suite in the Judgm.t afd specified as also for the sum of three
(326)   hundred and Twenty Six               pounds of tobacco by the Court here adjudged unto him for his Costs
and damages sustained by Occasion of delay of Execution of the Judgm.t afd &c
