272 the afd Thomas Layfield the fourth day of march seventeen hundred and twenty three at the County afd within the Jurisdiction of this Court by his Certain Writting Obligatory granted himselfe to be held & firmly bound unto the afd Levin Gale in the sum of twenty five pounds Curr.t money to be paid the same Levin when thereunto the afd Thomas should be required Yett the afd Thomas the afd sum of twenty five pounds Curr.t money to the same Levin hath not Rendered altho' often thereunto Required but the same Thomas the same hitherto to the same Levin to Render hath altogether denyed and still doth deny and unjustly detaine whereby the same Levin says he is worse and hath damage to the value of fifty pounds Like money and thereof he brings this Suite &c and the same Levin brings hereunto Court the writting Obligatory afd &c wch &c Levin Gale in ppson Pledges Jno Doe, Richd Roe And the said Thomas Layfield in his Own proper person Cometh & defendeth the force and Injury when &c and saith that he Cannot gainsay the plft his action afd so as afd against him brought nor Can he say but that the said Plft Ought to recover the debt afd in the Obligation afd mentioned and that the same is yett due wherefore the same plft prays Judgm.t for his debt afd and his Costs & damages sustained by occasion of the detaineing the same debt Therefore it is Considered by the Court that here the sixteenth day of March ann Dom One thousand seven hundred & twenty four that the said Levin Gale Recover against the said Thomas Layfeild as well the sum of twenty five pounds Curr.t money his debt afd as also the sume of (332) pounds of tobo for his Costs and damages sustained by occasion of the detention of the same debt to the same Levin by his assent by the Court here adjudged and the afd Thomas Layfeild in Mercy &c
County Greeting whereas a Certain William Ennalls Lately in Our County Court of Somersett to witt on the twenty second day of march in the fifth year of Our Dominion &c ann Dom One thousand seven hundred and twenty before the worshipfull Charles Ballard Gentl: and his associates ^these^ Justices of Our said Court and by Consideration of our said Court (at Dividing Creek) Recovered against a Certain Nehemiah Nicholson of Stepney parish in the County of Somersett planter as well the sum of Ninteen pounds five Shillings and seven pence Currency Certain Damages as also the Sum of three hundred and Sixty pounds of tobacco Costs laid Out and Expended by means of said Suite whereof he is Convict as by the Record and process thereof in Our Said Court Remaining manifestly appears Notwithstanding Execution of the Judgm.t afd as yett Remains to be done as by the Insinuation of the aforesaid (William) |
