271 Att which said third tuesday of march to witt the sixteenth day of the same month ann Dom One thousand seven hundred and twenty four being the day of the Return of the said Writt Cometh ye said Alexander Hall in his Own proper person and the sherr of Somersett County to whom the foregoeing Writt was directed Likewise Cometh and maketh Return thereof to the Court here Endorsed in these words following vizt Non Est Inventus p Jos: MccClester Sherr Whereupon the said Alexander Hall prays that forasmuch as he hath Complyed with the Laws in Order to an attachm.t he may have Judgm.t against the said William Francis for his damages afd by way of attachment according to act of assembly &c And for that it seemeth to the Court here that ye said Alexander Hall hath Complyed with the Law as alledged Therefore it is Considered by the Court here the Sixteenth day of March ann Dom One thousand Seven hundred and twenty four afd that the afd Alexander Hall Recover against the afd William Francis as well the Sum of Eight hundred twenty Eight pounds of tobacco his damages by Occasion of the premisses afd as all Costs and Charges by ye said plft Laid Out and Expended about (238) his suite by way of attachm.t against ye goods Chattells Rights or Creditts of the Said W.m Francis according to act of assembly in such Case made and provided &c
of Somersett County Gentleman Greeting Know Ye that we have appointed you or any three or two of you to be Our Commissioners to Examine Evidences in Relation to the bounds of a Certain tract of Land Lying in Somersett County in the forrest of Wickacomoco Called New holland Belonging to a Certain William Lingoe We therefore Require you or any three or two of you to Meat on the afd Tract of Land Called New holland On a Certain Time as to you or any three or two of you ^shall seem Convenient and that you Cause to Come before you or any three or two of you^ all such Evidences ^as should^ be to you or any three or two of you [illegible] By the said Complainant (or Deft) and That you Examine Them on Their Corporall Oaths to be by you or any three or two of you Administred on the Holy Evangelist in Presents of the Party's Concerned in the Premisses Touching the Truth or Remembrance of their Knowledge or any Thing that my relate to the Cause afd and That reducing their severall Depositions Into writting you send the same together with This Our Commission Under Your or any three or Two of your Hands to us to Our County Court of Somersett with all Convenient Speed Wittness Joseph Gray Gentl.m Chief Justice of Our Said Court the 24.th day of September (in) |
