(26) Maryland and thereupon he Brings Suite &.c Allen Prte Pledged P Jno Doe & R Roe And the said Teague Riggin by George Dashiel his attorney Comes and defends the force and Injury when &.c and Pray Leave to Imparle hereunto untill the next Court and he hath it and the same day is given to the Plft also Att which said next Court to witt the thirtieth day of aprill Ann Dom one thousand seven hundred and twenty three Comes again as well the said Plft by his attorney afd as the said deft by his attorney afd and the said deft by his said attorney as before defends the force and Injury when &.c and says that he is not guilty of the trespass by the afd John upon him Imposed in manner and form as the said John hath against him Complained and of this he puts himselfe upon the County &.c George Dashiel P Defte And the Plft in Like manner Allen P Qrte Thereupon Command is given to the sherr of Somrsett County that Immediately he Cause to Come here twelve &.c by whom &.c who neither &.c to recognize &.c because as well &.c of which said Preceipt the said sherr to witt Joseph Maulester ^Gent^ Now here at this day to witt the same day and year Last mentioned makes return that he has here ready twelve &.c as by his said Preceipt he was Commanded and Now hereafterwards to witt the same day and year Comes as well the said Plft as the said deft by their attorneys afd and the Jurors of that Jury Impanneled who being Called Likewise Came to wit William Lane John Dennis sen Henry Scofield Moses Fenton William Mills Daniel Cowdery, Neal Maulester, James West James Hall John Denwood John Gunby Robert Watson who being duely Elected tryed and sworn to say the truth in the Premisses upon their Oath do say wee of the Jury do find for the Plft five shillings damages W.m Lane foreman for as much as the damages afd found being not with in the Jurisdiction of of this Court to give Judgmt on the verdict afd for the Plft Therefore it is Considered by the Justices here the thirtieth day of Aprill Ann Dom one thousand seven hundred and twenty two afd that the said John Fleming take nothing by his writt and declaration afd but be in mercy for his falce Clamour and that the said Teague Riggin goe thereof without day and Likewise it is Considered by the Justices here that the said Teague Riggin recover against the said John fleming the sum of Two thousand three hundred and seventy five Pounds of tobo by the Court here adjudged unto him for his Cost and Charges by him also at his defence in this Behalfe Laid Out and Expended according to ye form of the Statute &.c
