263 her servitude according to the true Intent and Meaning of her said Indenture unless she Can further make it appear that she Never received the Consideration Money in the same Indenture mentioned &c
Pocomoke Called Kellams Choice the Bounds whereof are Rendered somewhat Precarious humbly prays your worships according to an act of assembly of this province for the perpetuating the bounds of Land &c your Worships would Grant a Commission to Examine Evidences in Relation thereto and as in duty bound your Petitioner Will Ever pray The petition afd being read and heard and the premisses Considered Its thereupon ordered by the Court that the said John Kellem have a Commission to Issue out of this Court to Examine Evidences to Perpetuate the bounds of his Land afd and that Nathaniell Hopkins Sen Southy Whittington, Edmond Hough and John Scarbrough all of Somersett County Gentl be Commissioners to Execute the Commission afd &c
Whereupon a Certain Peter Fitzgerrell present here in Court undertakes for the said Alice Oates and acknowledged himselfe to owe and stand Justly Indebted unto the Right honourable the Lord proprietary of the provinces of Maryland his heirs and successors in the sum of ten pounds sterr to be Levyed on his body goods or Chattells Lands or tenements for the use of his said Lordship the Lord proprietary In Case the said Alice Oates doe not stand & abide the Judgm.t of this Court and not to depart without Leave thereof Somersett fs: The Jurors for the right hon.rble the Lord proprietary of this province that now is for the body of Somersett County upon their Oath doe present that Alice Oats Late of Somersett Parish in Somersett County Spinster the first day of March Seventeen hundred & twenty four with force and Armes at the parish afd in the County afd within the Jurisdiction of this Court One Muslin Pinner of the value of fourteen shillings Curr.t money of this province of the goods and Chattles of a Certain William Jones then and there being found then and there did take Steal and Carry away against the peace of our said Lord proprietary his good rule and dignity and also against the force of the act of assembly In Such Case made & provided L Gale Clk Indictm.ts Test Isabell Mills (on) |
