 Henry Alexander Late of all hollows Parish in Somersett County
Planter was sumoned to answer unto Catherine Wood Exrx of the
Last will and Testam.t of Robert Wood Deceed of a Plea of
trespasse upon the Case    And whereupon the said
Catherine by Francis Allen her Attorney Complains that Whereas the afd Henry the first day of
November One thousand seven hundred and Twenty One at Somersett County afd within the Jur
of this Court was Indebted unto the said Robert in his Lifetime in four hundred & Ninety pounds
of Tobacco for so much By the said Robert to and for the Use of the said Henry to a Certain
Robert Martin Before that Time Deposited and paid and Being so thereof Indebted
the said Henry in Consideration thereof the day and year afd at the Place afd upon himself
did assume and to the said Robert in his Lifetime faithfully did Promisse That he the said
Henry the said four hundred & fifty pounds of Tobacco to the said Robert when he should be
Thereunto requested well and faithfully he would pay and Content Never the Lesse the said
Henry his promisse and assumption afd in forme afd Made Nothing reguarding But plotting
and fraudulently Intending the said Robert in his Lifetime and the said Catherine since the death
of the said Robert in that Part Craftilly and Subtilly to Deceive and Defraud tho' Often
Thereunto requested the said four hundred and Ninty pounds of Tobacco to the said Robert in his
Lifetime or to the afd Catherine since the death of the said Robert hath not paid but the same
to pay hath refused and still doth refuse and Deny to the retarding her of the said Catherine
In the Execution of the last will and Testament afd Whereupon she saith she is worse
and hath damage to the Vallue of Nine hundred pounds of Tobacco and thereupon she
Brings suite and Brings into Court here her Letters Testamentary by wch &c

    Whereupon it is Ordered by the Court that the said Catherine Woods Exrx as afd give security
    for Costs in Case nonsuite be Obtained against her in the plea afd thereupon the Said
