       the said Edmond Hough by his attorney afd prays that the said that the said John White to his declaration afd
may answer   thereupon the same John White in Custody as afd hath time given him till four of the Clock of
the after Noon of this same day to answer &c and afterwards in the same Court the same John White in Custody
as afd altho' solemnly Called Cometh not nor nothing thereof in Barr or preclusion of the action ^of the afd Edmd^ afd saith
by that the same Edmond Remains against the afd John White in Custody as afd thereof undefended &c
       thereupon the same Edmond his Damages by Occasion of the premisses against the afd John White in
Custody as afd Ought to recover but because it is not Known what damages the afd Edmond hath sustained
by occasion of the premisses   the Justices according to act of assembly in such Case made and provided at
the prayer of the said Edmond do assess the damages of the same Edmond by occasion of the premisses
beyound his Costs and Charges to seven pounds three shilling & Nine pence Curr.t money of maryland &c
       Therefore it is Considered by the Court here the same day and year Last mentioned that the
afd Edmond Hough Recover against the afd John White in Custody as afd as well the sum of seven pounds
three shillings and Nine pence Curr.t mony of Maryland his damage afd by the Justices afd in form afd
assessed as also the sum of three hundred & thirty one pounds of tobo by the Court here adjudged unto
him for his Costs and Charges by him about his suite in this Behalfe Laid Out & Expended & ye Deft in mercy &c
and afterwards the same John White present here in Court it thereupon againe Committed into the Custody
of the Sherr of Somersett County there to remain till the afd Edmond Hough of his damages and Costs afd should
be thereof fully Satisfyed the said Sherr present here in Court took Charge of the said John White accordingly
&c

       Whereas a Certain Mary Cavanough a Servant being Convict for the felonious Stealing of
   Certain Goods and Chattels belonging to a Certain Merrick Ellis and John Bannister and at
the Expiration of the Said Mary Cavanoughs Service Mr Jos: Gray her Master according to act
of assembly Returned her to the County Court of Somersett in order to be sold to satisfie unto
the said Merrick Ellis and John Bannister the four fould of the value of the goods from them
Stolen which four fould does amount to seven pounds four shillings &c       thereupon its
ordered by the Court that according to said act of assembly the Sherr of Somersett County sell
the said Mary Cavanough at publick Sale to the biggest bidder not Exceeding Seven Years
to satisfie unto the said Merrick Ellis and John Bannister the ^four fold of the^ value of the goods afd stolen
         Whereupon the said sherr Returns to this Court ^that he^ did sell the Said Mary Cavanough
at public sale for three thousand & thirty one pounds of tobacco to a Certain Wescott Gray &c

        John Scott of Somersett County Gentl being appointed as deputy (by to Capt John Tunstall deputty Commissary
        for Somersett County) to act if as Commisary in the absence of said Tunstall &c  The said John Scott
did repair to John Handy Gent one of the Justices for said County of Somersett & tooke ye oaths appointed
& subscribed ye oath of abjuration & test &c
