251 and prayeth Leave to Imparle hereunto untill the next Court and he hath it & the same day is given to the plft also Att which said next Court to witt the Eighteenth day of August ann Dom One thousand seven hundred and twenty four Came againe as well the said plft by his attorney afd as the said deft in his own proper person and the said deft prays further Leave to Imparle hereunto untill the Next Court and he hath it & ye same day is given to the plft also Att which said Next Court to witt the seventeenth day of November ann Dom one thousand seven hundred and twenty four Came againe as well the said Jeffr'y Flowers by his attorney afd as the said Thomas Layfeild in his Own proper person and thereupon the said deft saith that he Cannot gainsay the plft his action afd so as afd against him brought nor Can he say but that the said plft ought to recover his damages by occasion of the Premisses afd to six pounds Curr.t mony of vergenia and Costs of Suite against him which the said plft doth not Gain Say &c Therefore it is Considered by the Court here the same day and year Last Mentioned that the afd Jeffr'y Flowers Recover against the afd Thomas Layfield as well the sum of six pound Curr.t money (309) of vergenia his damages afd in form afd Confessed as also the sum of three hundred and Nine pounds of tobacco by the Court here adjudged unto him for his Costs and Charges by him about his suite in this behalfe Laid Out and Expended and ye Deft in Mercy &c
Part followes of a plea that he render unto the said Lord proprietary and the said Richard Hickman fifteen thousand pounds of tobacco which to ye said Lord proprietary and the said Richard Hickman he oweth and unjustly detaineth &c And whereupon the said Richard Hickman who as well for ye right honourable the Lord proprietary of this province as for himselfe in that part follows by Francis Allen his attorney saith that whereas in an act of assembly of this province made and past at a sessions of assembly begun and held at the City of annapolis the twenty sixth day of Aprill in the first year of the Reign of our Sovereign Lord George by the grace of God of Great Brittaine France and Ireland King defender of the faith &c ann Dom One thousand seven hundred and fifteen it was Enacted by the King's most Excellent Majesty that now is by and with the advice and Consent of his said Majesties Governour & Councell and assembly of the said province and ye authority of the same that any person or persons whatsoever that should wittingly or Willingly Entertain any Servant or Slave unlawfully absenting him her or themselves from him her or their Master Mistress dame or Overseer should be fined five hundred pounds of tobacco for Every Night or twenty four hours that such person or persons should give Entertainm.t as afd ye one halfe to his said Majesty his heirs and Successors for ye Support (of) |
