afd shall pay the Condemnation of the Court thereupon and all Costs accrewing thereon unto the said Robert
Martin adm as afd or that he the said Levin Gale will doe it for him &c

 This being an action of trespass upon the Case &c whereupon
the said Thomas Peal prays that the said William Burton
Executor of Ann Alexander may give security for Costs  In
                                              Case nonsuite be obtained against him in the plea afd which is by the Court
Granted, Thereupon Levin Gale of Somersett County Gentleman present here in Court undertakes for the
said William Burton Executor as afd that in case he be Nonsuited in the plea afd or otherwise Legally
Cast that then he the said William Burton shall pay the Condemnation of the Court and all Costs accrewing
thereon unto the said Thomas Peal or that he the said Levin Gale will doe it for him &c

parish in the County afd Gentleman was attached to answer unto Jeffery
                                     Flower of a plea of trespass upon the Case &c
                      And whereupon the same Jeffery by William Tazewell his attorney Complaines
       that whereas the afd Thomas the twenty fourth day of September ann Dom One thousand seven
       hundred and twenty three at the parish and County afd within the Jurisdiction of this Court had accounted
       with the same Jeffr'y of and Concerning divers sums of money to the same Jeffr'y by the afd
       Thomas before then due for divers wears and Merchatndize of the same Jeffr'y by the afd Thomas
       before that time bought had and Received and upon that accounting the afd Thomas Was then and
       there found in arrear towards the same Jeffr'y in the sum of six pounds Curr.t mony of Vergenia
       and being so thereof found in arrear the same Thomas in consideration thereof upon himselfe assumed
       and to ye afd Jeffr'y then and there forth fully promised that he the said Thomas the afd six pds
       Curr.t money as afd to the afd Jeffery when he should be afterwards thereto Required would well
       and faithfully Content and pay Nevertheless the afd Thomas his promise and assumption afd in
       form afd made not Regarding but minding and fraudulently Intending him the same Jeffr'y in
       this part Craftilly and Subtilly to deceive and defraud the afd six pounds or any part thereof unto
       the same Jeffr'y hath not paid altho' to do the afd Thomas the second day of December ann Dom
       seventeen hundred and twenty three at the parish and County afd within the Jurisdiction of this
       Court afd by the same Jeffry hath been Required but the same to him hitherto to pay hath
       Refused and Still doth refuse to the damage of the same Jeffery twelve pound Currt money as
       afd and thereof the brings suite &c          Tazewell P Quer pledges &c Jno Doe Richd Roe
       And ye said Thomas Layfeild in his own proper person Cometh & defendeth ye force and Injury when &c
