given to the plantiffe also      Att which said Next Court to witt the Eighteenth day of August ann Dom
One thousand seven hundred and twenty four Cometh againe as well the said plft as the said deft by
their attorneys afd and the said deft by his said attorney prayeth further Leave to Imparle hereunto
untill the Next Court and he hath it & the same days is given to the plft also
         Att Which said Next Court to witt the seventeenth day of November ann Dom One thousand seven
hundred and twenty four Came again as well the said plft as the said deft by their attorney afd & the
said deft by his said attorney as before defends the force & Injury when &c    and saith that he did not
assume upon himselfe in manner and form as the plft against him hath Complained and of this he putts
himselfe upon the Country &c       Levin Gale P Deft         And ye Plft in Like manner Allen P Plft
                   Thereupon Command is given to the Sher of Somersett County that Immediately he Cause
to Come here twelve &c by whom &c who neither &c ^to^ Recognize &c because as well &c of which said preceipt
the said Sherr to witt Joseph MccClester Gentleman Now here at this day to witt the same day and Year Last
mentioned makes Return that he hath here Ready Twelve &c as by his said preceipt he was Commanded and
Now here after^wards^ to witt the same day and year Came again as well the said plft as the said deft by their
attorneys afd and the Jurors of that Jury therein Impannelled ^who^ being Called ^Likewise^ Came to witt John Scott
Edward Round, John Dennis Sen, Henry Schofeild, James Harris, Charles Cottingham, Adam Spence Sen,
George Benson, Robert Mitchell, John Fleming, John Pope, Daniel Cordery, who being duely Elected
tryed & sworn to say the truth in the premisses upon their Oath do say that the said John Barkley
did assume upon himselfe in manner and form as the afd Cornelius Walkerson above against him hath
Complained and do assess the damages of the said Cornelius besids his Costs and Charges by him about his
Suite in that behalfe Laid out to six pounds ten shillings Curr.t money and for those Costs & Charges to
one pound of tob.o
                                        Therefore it is Considered by the Court here the seventeenth day of November
ann Dom one thousand seven hundred & f twenty four that the afd Cornelius Watkinson Recover against
the afd John Barkley his damages afd to six pounds ten shillings Curr.t money & one pound of tobo by
(1059)   the Jury afd in form afd assessed as also the sum of One thousand & fifty Nine         pounds of
Tob.o for his Costs and Charges by him about his Suite in that part opposed ^to^ the same Cornelius by the Court
here at his Request adjudged of Increas Adjudged & the deft in Mercy &c

 Whereas the said William Burton Executor of Ann Alexander haveing
Commenced two actions of trespass upon the Case against a Certain Robert
Martin adm.r of a Certain Edward Martin the said Robert Martin Humbly
prays that the said Edw William Burton Ex.r as afd may give Security for Costs
in Case non suite be obtained against him in the pleas afd which is by the Court granted   thereupon Levin Gale
of Somersett County Gentleman present here in Court undertakes for the said W.m Burton Ex.r as afd that
in Case he be nonsuited in ye pleas afd or otherwise Legally Cost that then he the said Wm Burton Exr as
