250 against the said William King as well the sum of four pounds four shillings and seven pence 210 halfe penny his damages by occasion of the premisses afd as all Costs and Charges by the Said plft Laid Out and Expended about his Suite by way of attachm.t against the Goods Chattells or Creditts of the said W.m King according to act of assembly in such Case made & provided &c
whereas the said John the twenty sixth day of march ann Dom One thousand seven hundred and twenty four at the County afd within the Jurisdiction of this Court was Indebted unto the said Cornelius in six pounds ten shillings Curr.t money of maryland as by acco.t hereunto annexed may in Court appear and being so thereof Indebted the said John in Consideration thereof the day and year afd at the place afd upon himselfe did assume and to the said Cornelius then & there did faithfully promise that the said John One New feather Bed and Boulster and thirty bushells of Indian Corn for ye Said six pounds ten shillings to the said Cornelius at the house of Edward Kellam upon Barron Creek Landing Called S.t Albans in Somersett County afd when he should be thereunto Requested well and faithfully he would pay and Content Nevertheless the said John his promisse and assumption afd in form afd made nothing Regarding but plotting and fraudulently Intending the Said Cornelius in that part Craftilly and Subtilly to deceive and defraud the said six pounds ten shillings to the said Cornelius hath not paid nor ye bed and boulster afd and the afd thirty bushells of Indian Corn in Lieu and for the afd six pounds ten shillings hath not paid or to him for the same in any wise Contented altho' the same to do the said John by the said Cornelius on the thirtieth day of march in the Year afd and often afterwards at ye County afd within the Jurisdiction afd he was thereunto requested but the same to him hitherto to pay hath refused and still doth Refuse and deny whereupon he saith he is worse and hath damage to the value of thirteen pounds Curr.t money of Maryland & thereof he brings Suite &c F Allen P Qrte pledges deps Jno Doe R Roe 1724 march 26.th John Barkley D.r to Cornelius Watkinson To a new feather Bed and Boulster @ £4..0..0 To 30 Bushells of Indian Corn @ 20 2..10.. Errors Excepted p Cornelius Watkinson 6..10..0 And the said John Barkley by Levin Gale his attorney Cometh & defendeth the force and Injury when &c and prayeth Leave to Imparle hereunto untill ye Next Court and he hath it & ye same day is (given) |
