249 the Justices of his Lordships County Court of Somersett to be held at dividing Creek the third tuesday of November then next to answer unto George Hutchins of a plea of trespass upon the Case &c and that thereof he should not fail &c And whereupon the said George P George Dashiell his attorney Complaines that whereas the said William in the year One thousand seven hundred and twenty two at Stepney parish afd within the Jurisdiction of this Court was Indebted unto him the Sum of Eleven pounds seventeen shillings and one peny as P acc.t hereunto annext may in Court appear and the same William being Indebted as afd at the time & place afd did upon himselfe assume and to the said George then and there did faithfully promisse that the afd Eleven pounds seven shillings and One penny for the severall articles in the acco.t Mentioned he would well and truly Content and pay when thereto requested and altho' seven pounds two shillings and five pence halfe penny the afd ^part of the debt afd the same^ William hath paid yett as to the Residue being four pounds four Shillings and seven pence halfe penny the afd William unto the afd George according to his promise and assumption afd in form afd made Little Regarding but plotting and fraudulently Contriving him the said George to deceive and defraud the afd sum of four pounds four shillings and seven pence halfe penny altho' often thereto Requested unto the same George he hath not paid but the same to pay hath denyed and still doth deny to the damage of the same George of Eight pounds Nine Shillings and three pence and thereof he brings suite Dashiell Pro qrte Pledges Jno Doe Richard Roe Ann Dom 1722 M.r William King Dr P Cr
and true sworne before me John Handy Att which said third tuesday of November to witt the seventeenth day of the same month ann Dom One thousand seven hundred and twenty four being the day of the Return of the said Writt Cometh the said George Hutchens by his attorney afd and the Sherr of Somersett County to whom the foregoeing writt we directed Likewise Cometh and maketh Return thereof to the Court here Endorsed in these words following viz.t Non est Inventus short note Left P mee Jos: MccClester Sherr Whereupon the said George Hutchens by his attorney afd prayeth that for as much as he hath Complyed with the Law in Order to an attachm.t he may have Judgm.t against the Said William King for his damages afd by way of attachm.t according to act of assembly &c whereupon for that it seems to the Court here that ye said George Hutchins hath Complyed with the Law as alledged Therefore it is Considered by the Court here the seventeenth day of November ann Dom One thousand seven hundred and twenty four afd that ye said George Hutchens Recover (against) |
