 Somersett County fs:  John Denston of Somersett County planter was attached to
answer unto James Caldwell of a plea of trespass upon the Case &c
And whereupon the same James P Geo: Dashiell his attorney Complaines
                that whereas the same John in the Year One thousand seven hundred and twenty two at the
          parish and County afd within the Jurisdiction of this Court was Indebted unto the same James
          in the Sum of Six hundred pounds of tobacco for two Linning Wheales as P account hereunto
          annext may in Court appear and the same John being Indebted as afd for the Consideration
          afd did upon himselfe assume and promise that the afd six hundred pounds of tobacco he
          would well and truly Content and pay when he should be thereto requested Nevertheless the
          said John his promise and assumption afd in form afd made Little Regarding but Contriving
          him the same James to deceive the afd sum of six hundred pounds of tobacco the said John hath
          not paid but the same to pay hath denyed and still doth deny to the damage of the same James
          of Twelve hundred pounds of tobacco and thereof he bringeth Suite

                                                      Errors Excepted Pr Ja Caldwell

                   And the said John Denson in his own proper person Cometh and defendeth the force and
          Injury when &c and says that he Cannot gainsay the plantiffe his action afd so as afd against
          him brought nor Can he say but that the said plft Ought to recover his damages by Occasion
          of the premisses afd to six hundred pounds of tobo and Costs of Suite against him which the Said
          plft doth not gainsay &c
                                                                 Therefore it is Considered by the Court here the seventeenth
          day of November ann Dom One thousand seven hundred & twenty four that the afd James Caldwell
          Recover against the afd John Denston as well the sum of six hundred pounds of tobacco his damages
(225)  afd in form afd Confessed as also the sum of Two hundred and twenty five pounds of
          tobacco by the Court here adjudged unto him for his Costs and Charges by him about his suit in this
          behalfe Laid Out & Expended and ye Deft in Mercy &c
