247 William Would have to Take a hive of Bees at the Branch of said runn and that hey Greer and would have Made a sier at the foresaid white Oake and that the said would have said to him the said Greer this Meaning the afd white Oake is Mr James Rounds Bounder and that he the said Greer saw that it was Marked with four Notches on Each side as afd and further sayeth Not The same Day to witt the second day of November Instant Came Jeremiah Townsend An Evidence on the afd Land Called Colleckmore to the foresaid fallen white Oak Markes as afd with a Mulbury Post sett up at the root of the same as afd and Being on the southwest side of a fresh water runn as afd about fifteen paces from the Main road and on the Northwest side of the same as afd and the said Jeremiah Townsend Aged sixty One years or their About on his Corporall oath administred ^to him^ as afd sayeth that Mr James Round Senior a Little Before he went to England which he thinkes was six or seven and Twenty Years Ago, Brough him the ^said^ Townsend to the fore mentioned ^Marked^ white Oak and said to him the said Townsend this is my Bounder and further sayeth Not The same second day of November Instant in Presence of the said Complainant (no Deft appearing) Came Capt William Fassett aged sixty two years or there abouts Before us the said William Selby, William Richardson, and Robert Martin on the afd Tract of Land Called Bleachinghirst to a Stump of a white oake and a Mulbury Post sett up by it on the Brink of a Steep bank on the southwest side of a fresh water runn By the side of a Path which was formerly a County road the said stump and Post Being a Bout Twenty Eight paces southwest from the said runn at which Place as here discribed the said William Fasett aged as afd Being By me Examined on his Corporall Oath as afd sayeth that forty five years ago or thereabout he Very well remembers he saw that a white Oak Marked or Notched on four sides where the afd stump now is and that he always ^understood^ that the said Marked white Oake was James Rounds Bounder and that he really thinks that the stump Last mentioned is the Stump of that Tree he saw Marked as afd at the time afd and severall times since and further sayeth not Att the same time and Place the above Mentioned the Complainant Aleadged that he had a Nother Evidence to produce Concerning the Last Mentioned Bounder Named Ephraim Heather who was the Next of the County as he suposed and at the said Complainants request wee Publickly in Presence of all person Adjourned and Appointed A Nother Meeting On the said Land Called Bleatchurst upon the fourteenth day of November Instant (and) |
