246 Evidences on Behalfe of a Certain James Rounds of the County afd Gentlm in relation to Two Tracts of Land the one Called Colleckmore ^and^ the Other Called Bleatchinghurst Lying in the County afd and that wee the above Mentioned John Purnell, William Selby, William Richardson and Robert Martin should Cause to Come before us or any three or two of us all such Evidences as should to us or any three or two of us be Nominated By the said Complainant and that wee or any three or two of us should Examine them upon their Corporall Oaths to be by us or any three or two of us Administred on the Holy Evangelist of almighty God in the Presence of the said Complainant and Defendant (if any) Touching the truth of their Knowledge or remembrance or anything that might related the Cause afd In Obedience to the which Precept wee William Selby, William Richardson, and Robert Martin above Mentioned Haveing Given due Notice Mett on the afd ^two tracts of^ Land Called ColeckMore and Bleatchinghust on the second day of November Instant and in Presence of the said Complainent (or defendant appearing) on that Tract of Land Called Coleckmore Came Coll John Franklin an Evidence aged Eighty seven years or thereabouts and on his Corporall Oath administred to him as afd sayeth that at a fallen Dead white Oak with a Mulbury post sett at the roote of it the said Oak Being marked with four Notches on Each side about fifteen Perches from the Main road Now Used and on the Northwest side of the said road that he the said Franklin Twenty five years agoe Knew the said Tree and that it was Marked as afd and that their was a flowrishing Tree but Cannot say whose Bounder it was and further sayeth not The same Day and at the same place Examined Capt William Fasitt on his Corporall oath as afd he Being Aged sixty Two Years or thereabouts on his oath administred to him as afd sayeth that forty five years agoe and frequently since he saw at saw the said white Oak as he rood along the road and that it was Marked on four sides with four Notches on Each side which now lyes Down fallen down and Dead as afd But knows Nothing whose Bounder it was farther then that he was Informed By severall peopell that it was Mr James Rounds Bounder and further saieth not The same day Came John Greer aged forty seven years or their abouts to the afd white Oak Marked with four Notches as afd and Being on the southwest side of a freshwater runn about fifteen paces from the Main road and on the North west side of the same as afd and on his Corporall Oath as afd Being By us Examined as afd say^e^th that about five or six and Twenty years agoe he the said Greer Came with (William) |
