245 The same to the said Mary to pay still Doth refuse and Deny to the retarding her on the Execution of the last will and Testament afd whereupon she saith she is worse and Hath damage to the value of thirteen hundred and sixty pounds of tobacco and thereof she brings suite and brings into Court here her Letters Testamentary by which &c Francis Allen P Qrte Pledgs afd Jno Doe R Roe And the said William Pepper by Levin Gale his attorney Comes and Defends the force and Injury when &c and Prays Leave to Imparle hereunto untill the next Court and he hath it and the same day is given to the Plft also Att which said next Court to wit the Eighteenth day of August Ann Dom One thousand seven hundred and Twenty four Came again as well the said Plft is the said Deft by their attorneys afd and the said P Deft by his said attorney Prays further Leave to Imparle hereunto untill the next Court and he hath it and the same day is Given to the Plft also Att which said next Court to witt the seventeenth day of November Ann Dom One thousand seven hundred and Twenty four Came again as well the said Plft as the said Deft by their attorney afd and the said Deft by his said attorney As before Defends the Force and Injury when and &c And the afd william by Levin Gale his attorney Comes and defends the force & Injury when &c And says he did not assume upon him selfe in Manner and forme as the afd Mary above against him hath Complained and of this he Puts himselfe upon the Country ^L Gale P Deft^ and the Plf in Like manner Francis Allen Thereupon Command is given to the sherr of somersett County that Immediatly he Cause to Come here Twelve &c By whome &c who Nither &c to recognize &c because as well & of which said Preceipt the said Sherr to witt Joseph M.cClester Gentl: Now here at this day to witt the same day and Year Last Mentioned Make returne that he hath here ready Twelve &c as by his preceipt he was Commanded And afterwards to witt the same day and Year Came as well the said Plft as the said Deft by their attorneys afd And the Jurors of that Jury therein Impannelled Being Called Came to witt John Scott Edward Rounds, John Dennis Sen, Henry Schoolfield, James Harris, Charles Cottingham, Adam Spence Senr, George Benston, John Townsend Jun, John Fleming, William Young, Daniel Cawdery, who Being duly Elected Tryed and sworn to say the Truth In the Premises upon Their Oath doe say that the said William Pepper did assume upon himselfe in Maner and forme as the said Mary Pope Exrx as afd above against ^him^ Hath Complained and Doe assess the damages of the said Mary Besides her Costs and (Charges) |
