244 Margarett Prays Judgment and her Debt afd Together with her Damages by occation of the Detaining of her said Debt to her to be adjudged and for Causes of Dammage shows to the Court the reasons following vizt or the said Abigail hath not Pursued the directions of the said Act of Assembly in Pleading the said Act of Limitation lastly the said Plea is deficient in matter of substance and is Double &c F: Allen P Qrte the deft Joyns in Dom Dashiell Whereup^on^ all and singuler the Premisses by the Court here soon heard and fully understood and Mature deliberation thereupon had ^it^ seemeth to the Justices here that the Plea afd by her the same rachel Exrx as afd in manner and forme afd above Pleaded and the matter in the same Contained ^are good & sufficient in law ye afd Margtt Lady Baltemore Exrx as afd of her action afd ag.t her ye same Rachell to preclude therefore it is^ by the Justices here the seventeenth day of November Ann Dom One thousand seven hundred and twenty four ^Considered^ that the afd Margarett Lady Baltemore Exrx of the Right Honrble Charles Lord Baron of Baltemore &c Take nothing by her writt and Declaration afd but be in Mercy for her falce Clamour and that the afd Rachell Stevens Exrx of the same Richard Stevens goe thereof without Day &c
William the Eighth day of January ann Dom One thousand seven hundred and twenty four twelve at the County afd within the Jurisdiction of this Court was Indebted unto the Said John Pope in his Life time in six hundred fifty three pounds of tobacco as by a Certain Note by the Said William signed herein Court dated the day and year afd may appear and being so thereof Indebted the said William Afterwards to witt the day and year afd at the place afd in Consideration thereof upon himselfe did assume and to the said John in his Life time then and there did faithfully promise that he the said William the said six hundred fifty three pounds of tobacco to the said John when he should ^be^ afterwards thereunto requested well and faithfully he would pay and Content Nevertheless the said William his promisse and assumption afd in form afd made Little regarding but plotting and fraudulently Intending the said John in his Life time and ye said Mary after ye Death of the said John in that part Craftilly and Subtilly to deceive & defraud the said six hundred fifty three pounds of tobacco to the said John in his Lifetime or to the afd Mary after the death of the afd John altho' the same to do the said William by the said John in his Life time to witt on the first day of may ann Dom One thousand seven hundred & thirteen and by the said Mary after ye Death of the said John to witt on the first day of Novem ann Dom One thousand seven hundred and twenty Two and often afterwards at the County afd within the Jurisdiction afd he was thereunto requested hath not paid nor Either of them hath paid and Contented And the Said Willm (the) |
