244 Baltemore saith she is worse and hath dammage to the Value of Nineteen hundred and twenty Pounds of Tobacco and thereupon she Brings Suit &c And she brings into Court her & the Letters Testamentary of the afd Charles Lord Baron of Baltemore &c by which &c It plainly appears the said Margarett to be Exrx and thereupon to have Admrcon &c F Allen P Quer Pledges or Jno Doe Rich Roe And the said Abigail Stevens Exrx as afd by George Dashiell her attorney Comes and Defends the Force and Injury when and &c And Prays Leave to Imparle hereunto untill the next Court and she hath it and same day is Given to the Plft also At which said Next Court to witt the sixteenth day of June Ann Dom One thousand seven hund and twenty four Came again as well the said Plft as the said Deft By their said attorneys afd and the said Deft by her said attorney prays further Leave to Imparle ^hereunto untill the next Court^ and she hath it and the same day is Given to the Plft also Att which said next Court to witt the Eighteenth day of August Ann Dom One One thousand seven hundred and Twenty four Came again as well the said Plft as the said Deft By their said attorneys afd and the said Deft by her said attorney Prays further Leave to Imparle ^hereunto untill the Next Court^ and she hath it and the same day is Given to the Plft also Att which said Next Court to witt the seventeenth day of November Ann Dom One thousand seven hundred and Twenty four Came again as well the said Plft as the said Deft by their said attorneys afd and the said Deft by her said attorney afd as before Defend the force and Injury when and &c And saith that the afd Margarett in her Capacity her action afd againest her to have Ought not to Because ^she^ saith that by a Certain Act of Assembly made at a Sesession of Assembly Begun and held at the City of Anopolis the twenty sixth day of Aprill in the first year of the reign of our Sovereig Lord King George by the Grace of God of Great Brittain france and Ireland King Defender of the faith &c Ann Dom One thousand seven hundred and fifteen ^it stands^ Enacted amongst Other things that all Actions Brought on any Bill Bond &c shall be Commenced within Twelve years from the day of the date thereof and whereas the said Margarett hath Comminced this Suite On An Obligation Dated the twentieth ^twelfth^ day of June Ann Dom One thousand six hundred and Eighty Eight so that no Action Being Comence within the Terme of Twelve Years afd Being the Time Limited By the said Act for Actions to be Brought On Obligations which she is ready to Verifie Wherefore the said Defendant in her said Capacity Prays Judgm.t if the Plft her Action againest her to have Ought &c Dashiell P Deft And the afd Margarett Lady Baltemore Saith that she by Any Thing by the afd Abigail in Barr above Pleaded from having her Action afd Ought not to be barred Because she saith that ye Plea afd an the matter in the same Contained are not sifficient in Law to Compell her the said Margarett to the same to answer And this she is ready to Verifie Wherefore for want of a Sufficient Plea of the afd Abigail in that Part the said (Margarett) |
