Called Cometh not nor to the Plea of the afd Deft answereth nor is her writt and Decaration afd
againest the same Deft further Prosecuted

Therefore it is Considered by the Justices here the same day and year Last mentioned that the afd
Margarett Lady Baltemore Exrx of the right Honourable Charles Lord Baron of Baltemore deceast
Take nothing By her writt and Declaration afd but that she and her Pledges of Prossecuting that
Is John Doe and Richard Roe be in Mercy &c  And ^that^ the afd Abigail Stevens Exrx of the afd
Richard Stevens Goe thereof without day &c

Somersett County fs  Abigail Stephens of Stepney Parishs in the County
of Somersett widdow Exrx of the Last will and Testam.t of ^Richard^ Stevens Late
of Somersett County afd Planter deced otherwise Lately Called Richard
Stevens of Somersett County in the Province of Maryland was Sumoned
to answer unto the Right Honorable Margarett Lady Baltemore widow and Exrx of
the Last will and Testament of the right Honrble Charles Lord Baron of Baltemore
Lately Deced of a Plea that she render unto her Nine hundred and sixty Pounds of Good
Sound Merchantable Tobacco which from her she unjustly Detaines &c   And whereupon
the said Margarett Lady Baltemore By francis Allen her attorney saith that whereas the
afd Richard in his Lifetime to witt The twelfth day of June Ann Dom one thousand
Six Hundred Eighty and Eight at Stepney Parish afd in the County af within the
Jurisdiction of this Court by his Certain writing Obligatory saith ^which^ the said Margarett
Lady Baltemore with the seale of the said Richard signed here into Court brings the
date whereof is the same day and year Did Acknowledge him selfe to Owe and Stand
Firmly Indebted unto the afd the right Honrble Charles Lord Baron of Baltemore in his
Lifetime in the afd Nine hundred and sixty Pounds of Tobacco to be paid unto the
said Charles Lord Baron of Baltemore when he should be thereunto requested Neverthelesse
the afd Richard in his Lifetime Nor the afd Abigail since the decease of the
said Richard the afd Nine hundred and Sixty Pounds of Tobacco unto the said Charles
Lord Baron of Baltemore in his Lifetime or the afd Margarett after the Death of
the said Charles Lord Baron of Baltemore have not rendered But the same to render
have denyed and the said Abigail the same to the said Margarett Lady Baltemore to
render still doth deny and unjustly Detain to the retarding her in the Execution
of the Last will and Testament afd Whereupon the said Margarett Lady
