       therefore it is Considered by the Justices here the seventeenth day of August ^Nov^ Ann Dom One thousand seven
hundred and twenty four afd that the said Benjamin Wailes recover againest the said Rachell Powell Admrx as
(294)   as well the sum of five hundred and fifteen Pounds of tobacco his Dammages afd in form afd Confesed as also
the sum of Two hundred & Ninty four                                                   Pounds of tobacco by the Court here
adjudged for his Costs and Charges by him about his suit in that Part Expended to be Levied of the Goods
and Chattles which were the afd Samuells at the Time of his Death in the hands of the said Rachell Admrx
as afd remaining to Be adminstred if so much in her hands she hath and if so much in her hands she
hath not then the Costs afd to be Levied of the Proper Goods and Chattles of the afd Rachell and the deft
in Mercy &c

the County afd dec.d Otherways Called Richard Stephens of Somersett County
in the province afd was Sumoned to answer unto the Right honrble
                                     Lady Baltemore widdow and Exrx of the Last will and testament of the Right honrble
       Charles Lord Baron of Baltemore Lately dec.d of a plea that he Render unto her the full and Just quantity
       of seven hundred and twenty pounds of good sound merchantable Leafe tobacco and Casque which from her
she unjustly detains &c
                                                    And Whereupon the said Margarett Lady Baltemore by Levin Gale
her attorney saith that whereas the afd Richard in his Life time to witt the third day of aprill ann Dom One
thousand seven hundred and Eighty Eight at Stepney Parish afd in the County afd within the Jurisdiction
of this Court by his Certain Wrighting Obligatory which the Said Margarett Lady Baltemore with the Seall of
the said Richard in his Lifetime signed here into Court brings the date whereof is the same day and year afd
did acknowledge himselfe to be held and firmly Indebted unto the afd Right honourable Charles Lord Baron
of Baltemore in his Lifetime in the afd full and Just quantity of seven hundred of and twenty pounds of good
merchantable Tobacco and Casque to be paid unto the said Lord baron of Baltemore upon the
tenth day of October next Ensuing the date of the writing Obligatory afd never the less the afd
Richard in his Life time nor the afd Abigail Exrx as afd the afd seven hundred and
Twenty Pounds of Good sound Merchantable Leaf Tobacco and Casque to the afd Lord Baron
of Baltemore in his Lifetime or to the afd Margarett Lady Baltemore Exrx as afd since the
Death of the same Lord Baron of Baltemore although often thereunto required to the sd
Lord Baron of Baltemore in his Lifetime or to the said Margarett Lady Baltemore since
His death have not rendered but the same to render have denies and the said Abigail
the same to the said Margarett Lady Baltemore to render still doth Deny and Unjustly
