242 And the afd Rachell Powell Admrx as afd by George Dashiel his attorney Comes and defends the force and Injury when &c and prayeth Leave to Imparle hereunto untill the next Court and she hath it and the same day is given to the plft also Att which said next Court to witt the seventeenth day of march ann Dom One thousand seven hundred and twenty three Cometh againe as well the said plft as the said deft by their attorneys afd and the said defendt by her said attorney prays further Leave to Imparle hereunto untill the next Court and she hath and the same day is given to the plft also Att which said next Court to witt the Sixteenth day of June ann Dom One thousand seven hundred and twenty four Cometh againe as Well the said plft as the said deft by their attorneys afd and the said deft by her said attorney prays further Leave to Imparle hereunto untill the next Court and she hath it and the same day is Given to the plft also Att which said next Court to witt the Eighteenth day of Augt ann Dom One thousand seven hundred & twenty four Cometh Again as well the said plft as the said deft by their attorneys afd and ye said deft by her said attorney prays further Leave to Imparle hereunto untill the Next Court and she hath it and the same day is given to ye plft also Att which said next Court to witt the seventeenth day of November ann Dom one thousand seven hundred & twenty four Cometh againe as well the said plft as the said deft by their attorneys afd and the hat said deft by her said attorney as before defends the force & Injury when &c and saith that the said Benjamin his action afd against her the said Rachell in her said Capacity thereupon Ought not to have and maintain because she saith that before the Sueing out of the Originall Writt of him the said Benjamin againest the said Rachell in the Plea afd the Debt in the said Benjamin Declaration Charged was Not first Demanded and required By the said Benjamin Either of the Proper pson of the said Rachell in her Capacity or at her habitation or Place of residence according to the form of an Act of Assembly of this Province Now in force in such Cases made and Provided and this she is ready to Verifie and Prays Judgm.t and that the said Benjamin from haveing his Action afd againest her the said Rachell in her said Capacity thereupon may Be barred Daniell P Deft And afterwards in the same Court Before the Justices thereof Cometh the said Rachell Powell administratrix as afd By her attorney afd and relinquisheth her Verification afd by her above Pleaded and says that she Cannot Gainsay the Action afd againest her Brought Nor but that the said Plantife Ought to recover his dammages by occation of the Premises afd to five hundred and fifteen Pounds of Tobacco and Costs of Suit to be Levey'd of the Goods and Chattles of the afd Samuel Powell Deceast in her Hands remaining to be adminstred &c (therefore) |
