241 Formerly a Beaver Dam and Further sayeth not as Wittness our Hands this Eighteenth Day of November Ann 1724 Benjamin Burton, William Selby
Samuel in his Lifetime to witt the second day of November ann Dom One thousand Seven hundred & Nineteen at the parish and County afd within the Jurisdiction of this Court was Indebted unto the same Benjamin in twelve hundred seventy seven pounds of tobacco as by acco.t hereunto annexed may appear and being so thereof Indebted the said Samuel in his Lifetime afterwards to witt the day and year afd at the place afd in Consideration thereof upon himselfe ^did^ assume and to the said Benjamin then and there did faithfully promise that he ye said Samuel the said twelve hundred seventy seven pounds of tobacco to the said Benjamin when he should be afterwards thereunto requested he would well and faithfully pay and Content and altho' the said Samuel in his Lifetime did satisfie and pay to the said Benjamin seven hundred and sixty two pounds of tobacco percell of the afd twelve hundred seventy ^&^ seven pounds of tobacco Yett as to five hundred and fifteen pounds of tobacco residue thereof the said Samuel in his Lifetime nor the afd Rachell since his death to whom administration of all and singular the goods and Chattells Rights and Creditts of the said Samuel at the time of his death in due form of Law was Committed; the promise and assumption afd of the afd Samuel in his Lifetime in form afd made Nothing regarding but plotting and fraudulently Intending ye said Benj.a in this behalfe Craftilly and Subtilly to deceive and defraud the said five hundred & fifteen pounds of tobacco to the said Benjamin altho' the same to doe the said Samuel in his Lifetime to witt on the third day of November afd in the year afd and the said Rachell after the death of the said Samuel to witt the first day of Novem afd in the year afd and the said Rachel after the death of the said Samuel to witt on the first day of November ann Dom one thousand seven hundred & twenty two and often afterwards at the parish and County afd within the afd Jurisdiction they were thereunto requested have not paid or Contented nor Either of them hath paid or Contented but the same to him hitherto to pay have refused and the said Rachell the same to the said Benjamin to pay still doth refuse and deny Whereupon the Said Benjamin saith he is worse and hath damage to the value of one thousand & forty pounds of tobacco and thereupon he brings Suite &c F Allen P Quer Pledgs deps Jno Doe Richd Roe
