The Execution of the within Commission appears By a Certain scheadle hereunto anexed                       
annexed                                                                               Benja Burton & William Selby

                   Somersett County in Maryland fs  By Vertue of a Preceipt from the worshipfull
Court Bearing Date the Ninteeth day of August Ann 1724  And Impowering us Benjamin
Burton Ephraim Heather Capt Edward Rounds and William Selby or any Three or Two of us
To Appoint a Certain Day to meet on a Certain Tract of Land Called assateague fields Belonging
To Ebenezer Crapper and Cause to Come Before us or any Three or Two of us all such Evidences
as shall Be Nominated By the said Complainant or Defendant and Examine them On their
Corporall oath to ^be^ by us Benjamin Burton Ephraim Heath Capt Edward rounds and
William Selby Or any Three or Two of us Administred on the Holy Evangelist in the Presents
of the said Complainant or Defendant Touching the Truth or remmembrance of their Knowledge
Or any Thing That may relate to ^the^ Cause afd      And in Obedience to the said Commission
from the worshipfull Court as afd To Benja Burton, Ephraim Heather Capt Edward Rounds and
William Selby On the third Day of November in ye Year of our Lord one thousand seven
Hundred and Twenty four Wee Benjamin Burton and William Selby after Due Notis Given
Mett on the Land of Ebenezer Crapper Called Assateague Fields and Coll John Franklin
Aged Eighty seven years or thereabouts our Evidence Being Examined By us on his Corporall
oath sworne on the Holy Evangelist of almighty God By us Benjamin Burton and
William Selby Did say that he Very well remembred in the year of Our Lord God One thousand
six hundred and Ninty or thereabouts and severall times since see a Marked Tree stand on
a Point of sand Leading on to a Certain Island Called Charles Choyce and Did hear severall
People say that that said Marked Tree was the Bounder of the said Tract of Land Called
assateague Fields and further sayeth Not                                                Then Came Capt Wm
Fassitt aged sixty Two years or thereabouts a Second Evidence on his Corporall oath sworn by us
on the Holy Evangelist By us Benjamin Burton and William Selby and By us Examined of all
He Knew in Relation to the Bound of the afd Tract of Land and he Did say that he Very well
Remembers in ye Year of our Lord God one thousand six hundred and Eighty or their abouts
and severall Times sence he did see a marked white oake marked on four sides standing on
the afd Poynt of sand Leading on to a Certain Island Called Charles Choyce and Did Deeme the
said Marked Tree to be the Bounder of the afd Tract of Land Called assateague Fields By reason
He Did severall Times Hear People Talk to that Effect and Now the Tree Being Dead and Gone
There stands a Sliped Tree about seventy yards North west from a Small Slash or Foot Bridge
Leading onto a Certain Island Called Charles Choyce which Tree sliped afd stands Near upon
the Place where the Ould Bounder stood on the south side of a Small Creek where was
