240 and fifteen shillings Curr.t money for work and Labour by him the said John for the said Mathews's Request before that time there done and performed and being soe thereof Indebted he ye same Mathews in Consideration thereof upon himselfe assumed and to the same John then and there faithfully promised that he the said mathews the afd forty bushells of Corn and fifteen shillings Curr.t money when he should be afterwards thereto required unto ye said John Would well and truely Content and pay Nevertheless the afd Mathews his promise and assumption afd in form afd made not Reguarding but minding and fraudulently Intending the afd John in this part Craftilly and Subtilly to deceive and defraud the afd forty bushells of Corn and fifteen shillings or any part thereof unto the same John Hath not paid altho' the same Mathews by the same John the tenth day of September ann Dom Seventeen hundred & twenty three at the parish and County afd within the afd Jurisdiction hath been Required but the same hitherto to him to pay hath refused and still doth refuse to the damage of the said John Eighty Bushells of Indian Corn and three pounds Curr.t money and thereof he brings Suite &c Tazwell P Quer Pledges &c Jno Doe Richard Roe And the said William Mathews by Francis Allen his attorney Comes and defends the force and Injury when &c and prays Leave to Imparle hereunto untill the next Court and he hath it and the same day is given to the plft also Att which said next Court to witt the seventeenth day of march ann Dom one thousand seven hundred and twenty three Come againe as well the said plft as the said deft by their attorneys afd and the said deft by his said attorney prays further Leave to Imparle hereunto untill the next Court and he hath it and the same day is given to the plft also Att which said next Court to witt the Sixteenth day of June ann Dom One thousand seven hundred and tweny four Come again as well the said plft as the said deft by their attorneys afd and ye said deft by his said attorney prays for the Leave to Imparle here untill the next Court and he hath it and the same days is Given to the plft also Att which said next Court to witt the Eighteenth day of August ann Dom One thousand seven hundred and twenty four Comes again as well the said plft as the said defendent by their attorney afd and ye said deft by his said attorney prays further Leave to Imparle hereunto untill the next Court and he hath it and the same days is given to the plft also Att which said next Court to witt the seventeenth day of November ann Dom One thousand seven hundred and twenty four Come againe as well the said plft as the said deft by their attorneys afd and the said deft by his said attorney as before defends the force and Injury when &c and Saith that he did not assume upon himselfe in Manner and form as the plft ag.t him hath Complained and of this he puts himselfe upon the Country Allen P Deft and ye Plft in like manner Tazwell (thereupon) |
