238 Patrick Daley will do it for him thereupon the same Thomas Vallins appears & Imparles till next Court &c
Called appears and thereupon the said Thomas Layfeild at the prayer of the plfts attorney afd is adjudged to give speciall bail to the action afd thereupon a Certain Thomas Hearn of Somersett County planter present in Court undertakes for the said Thomas Layfeild that if in Case the said John Pitts shall Recover Judgm.t in the plea afd against the said Thomas Layfeild or that the said Thomas Layfeild shall be therein Convict that then he the Said Thomas Layfeild shall pay the Condemnation of the Court thereupon or Render his body to the Costody of the Sherr of Somersett County In Satisfaction thereof or that he the said Thomas Hearn will do it for him thereupon the said Thomas Layfeild in his own proper person appears and Imparles till next Court &c
Court of Somersett to be held at dividing Creek in the third tuesday of Novem then next to answer unto George Tull of a plea that he render unto him one thousand pounds of tobacco which to him he owes and unjustly detaines &c and that thereof he should not fail &c And the said George Tull by declared against the said Aaron Jordeen in the plea afd as followeth vizt Somerset County fs: aaron Jordeen of Coventry parish in Somersett County Carpenter al.s dicts Aaron Jordeen of the afd County and province was Sommoned to answer unto George Tull of a plea that he render unto him one thousand pounds of tobacco which to him he owes and unjustly detaines &c And Whereupon the said George by Francis Allen his attorney saith that Whereas the afd Aaron the sixth day of January anno Dom One thousand seven hundred and twenty three at the County within the Jurisdiction of this Court by his Certain Writting Obligatory acknowledged himselfe to be bound unto the said George ^in the afd one thousand pds of tobo to be paid unto the said George^ when he should be thereunto Required Yett the said Aaron tho' often required the said one thousand pounds of tobacco to the said George hath not Rendered but the same to him hitherto ^to^ Render hath denyed and still doth deny and unjustly detain to the (damage) |
