235 submitts to the Mercy of the Court and is willing to make fine to the said Lord proprietary &c Wherefore Its Considered by the Justices here that the said Daniel Davis be fined five hundred pounds of tobacco to the use of the free School thereupon the Said Daniel Davis is Committed into the Custody of the Sher of Somersett County untill he should satisfie the fine afd and all the Officers Fees due by occasion of the premisses afd the said sher to witt Joseph MccClester Gentl: present in Court took Charge of the Said Daniel Davis accordingly &c Thereupon the said Daniel Davis is Ordered by the Court to give security for his good behaviour and appearance at next Court &c Whereupon the said Daniel Davis present in Court acknowledged himselfe to Owe & Stand Justly Indebted unto his Lordship the Right honrble the Lord proprietary of this province in the sum of ten pounds sterr to be Levied on his body goods or Chattells Lands or tenements for the use of his Said Lordship In Case he doth not make his personall appearance before the Justices of his Lordship's County Court of SOmersett to be held at Dividing Creek ye third tuesday of March Next to answer unto his said Lordship Concerning al such Matters & things as shall be then & there Objected against him on his said Lordship behalfe and to stand & abide the Judgmt of the Court thereupon & not to depart the Same Court without Lycence thereof & in the Mean time to be of ye good behaviour to all his Lordship's Leige people & Especially to John Smith afd Likewise a Certain William Pointer present in Court undertakes for the Said Daniel Davis and acknowledged himselfe to owe & Stand Justly Indebted unto his Said Lordship the Lord proprietary his heirs and successors in the sum of five pounds sterr to be Levied on his Body Goods or Chattells Lands or tenements for the use of his said Lordship In Case the said Daniell Davis doe not make his personall appearance before the Justices of his Lordships County Court of Somersett to be held at Dividing Creek the third tuesday of March next to answer unto his said Lordship Concerning all such Matters and things as shall be then & there Objected against him on his said Lordships Behalfe and stand & abide the Judgm.t of the Court thereupon & not to depart the same Court without Lycence thereof and in the Mean time to be of the good behaviour to all his Lordships Leige people and more Especially to the said John Smith &c
