228 unto the abovesaid John James Cornelius & Comfort deverix their heirs Exrs or assignes their full & Just Portions to be paid them according to the Will of the said dec.d when they shall attain to full age according to act of assembly then the above Obligation to be void Otherwise to remain in full force & vertue Signed Sealed & Delivered in the presence of her marke Ann A Deverix (seal) Thomas Hayward, William Taylor Samuel Deverix (seal) W.m Hopkins (seal) his Cornelius C Ennis (seal) marke
afd within the Jurisdiction of this Court was Indebted unto the said Thomas in the sum of Eight hundred pounds of tobacco for so much by the said Thomas for the said James at the Speciall Instance & Request of the said James then & there before that time deposited & paid and Being so thereof Indebted the said James in Consideration thereof the day & year afd at the place afd upon himselfe did assume and to the said Thomas then & there did faithfully promise that he the said James the said Eight hundred pounds of tobacco to the said Thomas when he should be afterwards thereunto requested well and faithfully he would pay & Content Nevertheless the said James tho' Often Requested the said Eight hundred pounds of tobacco to the said Thomas he hath not paid but the same to him hitherto to pay hath refused & still doth refuse & deny whereupon the said Thomas saith he is worse and hath damage to the value of sixteen hundred pounds of tobacco and thereupon he Brings suite &c F Allen P Qrte Pledgs dep Jno Do Ro Roe Whereupon the said James Henderson present in Court is at the prayer of the plfts attorney afd adjudged to give Speciall Bail to ye action afd thereupon a Certain Francis Henderson of Somersett County planter present here in Court undertakes for the said James Henderson that if in Case the said Thomas Dukes shall Recover Judgmt in the plea afd against the said James Henderson or that the said James Henderson shall be therein Convict that then he the said James Henderson shall pay the Condemnation of the Court or render his Body to the Custody of the sherr of Somersett County in satisfaction thereof or that he ye said Francis Henderson will doe it for him &c Whereupon the said James Henderson in his Own proper person Comes & defends the force and Injury when &c and says that he Cannot gainsay the plft his action afd so as afd against him brought nor Can he say but that the said plft Ought to recover his damages by occasion of the premisses afd to Eight hundred pounds of tobo & Costs of suite against him while the said plft does not gainsay &c Therefore it is Considered by the Justices here the Eighteenth day of aug.t ann Dom One thousand seven hundred & twenty four that the said Thomas Dukes Recover agt the said James Henderson as well the sum of Eight hundred pounds of tobo Certain damages afd in form afd Confessed as also the sume (of) |
