227 the plft also Att which said next Court to witt the Eighteenth day of August ann Dom one thousand seven hundred & twenty four Come again as well the said plft ^by his attrny afd^ as the said deft in his proper person and the said deft says that he Cannot Gansay the plft his action afd so as afd against him brought nor Can he say but that the said plft Ought to Recover his damages by Occasion of hte premisses afd & Costs of Suite against him which the said plft does not gainsay Whereupon at the prayer of the plfts attorney and by the Consent of the deft the Justices here according to act of assembly in Such Case provided do assess the damages of the same plft by occasion of the premisses afd beyound his Costs and Charges by him about his suite in that part Expended to five pounds Curr.t money of this Government &c Therefore it is Considered by the Justices here the same day & year Last mentioned that the said Capell King Recover against the said Alexander Hall as well teh sum of five pounds Curr.t money of this Governm.t his damages afd in form afd by the Justices assessed as also the sume of (751) seven hundred & fifty One pounds of tobacco by the Court here adjudged unto him for his Costs and Charges by him about his suite in this Behalfe Laid Out & Expended & ye defend.t in mercy &c
Orphans of Mathew Nutter dec.d in the full & Just Sum of two hundred & eight pounds three shillings Curr.t money to be paid unto the said Orphans their heirs Exrs adm.rs or assignes to the which paymt well & truly to be made & done wee Bind Our Selves Our and Each of Our heirs Exrs and adm.rs for the whole & in ye whole Joyntly and Severally firmly by these presents Sealled with our Seals and dated this 23d day of Sep.tr ann Dom 1724 The Condition of the above Obligation is such that iof teh above Bound Alexander Lackey his heirs Executors ^or^ adm.rs or assignes do well & truly pay or Cause to be paid unto the abovesaid Jn.o Huett Nutter Mathew Nutter and Rachell Nutter their heirs Ex.rs adm.rs or assignes the full & Just sume of one hundred & four pounds one shilling & six pence when they shall attain to full years according to act of assembly then the above Obligation to be void Otherwise to Remain in full force & vertue &c Signed Sealed & Delivered Alexander Lackey (seal) In the presence of us Ephraim Willson (seal) Thomas Hayward Geo: Dashiell W.m Whittington (seal) |
