the attorneys of the Court of the Right honrble the Lord proprietary here present here in Court in his proper person the tenor of which bill follows in these words to the Justices of the Right honourable the Lord proprietary of the County Court here now held for the County of Somrsett Capell King by Francis Allen his attorney Complains of Alexander Hall One of the attorneys of the Court of the Right honourable the Lord proprietary present here in Court in his proper person of a plea for that whereas he the said Capell is a good true faithfull and an honest subject of Our Lord the King now and as such a subject from the time of his Nativity hitherto hath always behaved held & Governed himselfe and from all Kind of theft felony Larceny or any such Like Kind of hurtfull Crime or Blott altogether free untoucht and unattainted hath remained Nevertheless the said Alexander not being Ignorant of the premisses but of his were Most wicked Malice forethought plotting him the said Capell in his good Name fame Creditts and Reputation to hurt detract & make worse and him the said Capell into Scandall and Infamy amongst his Neighbours & Other faithfull subjects of Our Lord the King now unworthaly to Induce the sixteenth day of June One thousand seven hundred & twenty four at the Court house in Somersett County within the Jurisdiction of this Court the said Court then and there at Dividing Creek being held for the said County having Communication and Speech with him the said Capell at the presents and hearing of sundry faithfull subjects of our Lord the King now to whom the said Capell was Known did falcely and Maliciously Speak assert release pronounce & with a high voice publish these falce feigned scandelous Malitious & Opprobrious words following to and of him the said Capell viz.t you (speaking to and of him the Said Capell) are a hogg stealing son of a bitch) you) stole my turkeys Geese and Chickens) when as in truth the said Capell as such wicked or base Crime Ever Committed or Perpetrated by Reason of the Speaking publishing and asserting of which falce Infamous Malitious and Scandalous ^words^ the Said Capell not Only in his good Name fame Creditt Estimation and Repute afd is very much hurt and damnified but also in Lyable Innocently to be brought into danger of forfeiting four fold suffering Corporall Punishment and the Pillowry as the Law in Such Cases directs and sundry sums of Money and tobacco for the Clearing his Innocency in that part is Oblidged to Expend Whereupon the Said Capell saith he is worse and hath damage to the value of fifty pounds Curr.t money of this Governm.t & thereupon he Brings Suite &c F Allen P Qre Pledgs deft Jno Doe R Roe And the said Alexander Hall in his Own proper person Comes & defends the force & Injury when &c and prays Leave to Imparle hereunto untill the next Court & he hath it & the same day is given to (the) |
