226 Eight shillings and Eight pence to the said John in his Lifetime or ^to^ the afd Rose whilst she was sole after ye decease of the said John or the afd Joseph and Rose Since the Espousalls between them Celebrated hath not Rendered but the same to them or any of them hitherto to Render hath denyed and the same to the said Joseph and Rose to Render still doth deny and unjustly detain to the retarding them in the Execution of the Last will and testam.t afd whereupon they say they are the worse and have damage to the value of ten pounds Curr.t money afd & thereof they bring suite and they bring into Court here the Letters testamentary afd of ye afd John by which it plainly appears to the Court here the afd Rose to be Exrx of the Last will and testament afd and thereupon to have administration &c F Allen P Qrt Pledges deft Jno Doe & R Roe Att Which said next Court to witt the Eighteenth day of August ann Dom One thousand seven hundred & twenty four Comes again the said Joseph Shippin & Rose his wife Exrx as afd by their attorney afd and whereas a Copy of the above declaration in the plea afd was made to be served on the said deft in Custody ^as^ afd. Whereupon the said Joseph Shippen and Rose his wife Exrx as afd as by their attorney afd pray that the said Arthur Hayman in Custody as afd to their declaration afd may answer thereupon the afd Arthur Hayman in Custody as afd hath time given him by the Court untill the second day of this term to answer &c And the same Arthur Hayman in Custody as afd at the same day altho' solemnly Call'd Cometh not nor nothing thereof in Barr or preclusion of the action afd says whereby the same plfts remains against the same deft thereof undefended &c Therefore it is Considered by the Justices here the ^Eighteenth^ Ninth day of August ann Dom One thousand seven hundred & twenty four that the said Joseph Shippin and Rose Exrx of the said Jno MccWilliams Recover against the Said Arthur Hayman in Custody as afd as well the sum of twelve pounds Eight shillings and Eight Pence Curr.t money their debt afd as 319 also the sum of three hundred and Ninteen pounds of tobacco by the Court here adjudged unto them for their Costs and Damages sustained by Occasion of ye Detaining the same Debt & ye Defnt in Mercy &c whereupon the said Arthur Hayman at the prayer of plfts by their attorney afd is Committed into the Custody of the the sherr of Somersett County there to remain untill such times as the plfts of their Debt and Costs afd shall be fully Satisfied &c |
