225 Prentice at the prayer of the plfts attorney is adjudged to give Speciall Bail to the action afd thereupon a Certain Tobias Burke and David Johnson of Somersett County Planters present here in Court undertakes for the said Robert Prentice that in Case the said John Evans Jun adm.r as afd shall recover Judgm.t in the plea afd against the said Robert Prentice or that the said Robert Prentice shall be therein Convict that the he the said Robert Prentice shall pay the Condemnation of the Court thereupon or Render his Body to the Custody of the Sherr of Somersett County in satisfaction thereof of that they the said Tobias Burke called it And David Johnson will do it for him &c thereupon the said Robert Prentice by Francis Allen his attorney appears & Imparles till next Court
Whereupon the said Arthur Hayman being Present herein Court is at the prayer of the plft attrny adjudged to give Speciall Bail to the action afd but for want thereof the said Arthur Hayman is Committed into the Custody of the Sherr of Somersett County thereto Remain &c the said Sher being present took Charge of the said Arthur Hayman accordingly thereupon day is given unto the said Arthur Hayman in Custody as afd untill next Court and the same day is given to the plfts also And the said Joseph Shippin and Rose his wife Exrx as afd by ^Francis Allen^ their attorney delared against the said Arthur Hayman in the plea afd as follows vizt Somersett County fs Arthur Hayman Late of Stepney Parish in Somersett County Planter al.s dict Arthur Hayman of wickacomoco Creek in Somersett County in maryland Carpenter was sommoned to answer unto Joseph Shippin and Rose his wife Relict and Exrx of the Last will and testament of John MccWilliams dec.d of a plea that he render unto them twelve pounds Eight shillings and Eight pence Curr.t money of this province which from them he unjustly detains &c And whereupon the said Joseph and Rose by Francis Allen his attorney say that whereas the said Arthur the twenty Eighth day of September in the year of Our Lord One thousand seven hundred & sixteen at the parish and County afd within the Jurisdiction of this Court by his Certain Writing Obligatory which the said Joseph and Rose with the seall of the said Arthur signed here into Court Being the date whereof the same day and year did acknowledge himselfe to be bound unto the afd John in his Lifetime in the afd twelve pounds Eight shillings and Eight Pence Curr.t money of this province to be paid unto the said John when he should when he should be thereunto Required Yett the said Arthur tho' Often Required the said twelve pounds (Eight) |
