224 two before the Worshipfull Charles Ballard and his associates then Justices of Our Said Court at dividing Creek and by Consideration of Our Said Court Recovered against against a Certain James Jones Sen of Stepney parish in Somersett County planter as well the sum of five hundred & ten pounds of tobacco Certain damages as also the sum of two hundred & Ninty One pounds of tobacco by the same Court adjudged unto him for his Costs and Charges by him about his Suite in this Behalfe Laid Out and Expended whereof he is Convict as by the Record & process thereof in our said Court Remaining manifestly appears Execution of the Judgm.t afd as yett Remaines to be done as by the Insinuation of the said Robert We have Received and because we will that those things which in Our said Court are Rightly done and acknowledged should be brought to a due Execution Command you that by good & Lawfull men of your Bailywick you make Known unto the said James Jones that he be and appear before the Justices of Our County Court to be held at Dividing Creek in Somersett County afd the third tuesday of august next to shew Cause if anything for himselfe he hath or Knoweth to say why the afd Robert Martin should not have his Execution of the Judgmt afd against him the said James Jones according to the form of the acknowledgm.t & Recovery afd he ought not to have if to him it shall seem meet and have you then & there the Names of those by whom you make the same Known and this writt Wittness Joseph Gray Gent Chiefe Justice of our said Court ye 20.th day of June in the Ninth year of our Dominion &c ann Dom 1724 (F Allen) Thomas Hayward Cler Att Which said third tuesday of August to witt the Eighteenth day of the same month ann Dom one thousand seven hundred & twenty four Being the day of the Return of the said Writt Cometh the Said Robert Martin by his attorney afd and the sherr of Somersett County to whom the foregoeing writt was directed Likewise Cometh & maketh Return thereof to the Court here Endorsed in these words following vizt To the worshipfull Justices within Mentioned I humbly Certifie that I have made Known unto the within Named James Jones that he be & appear before the Justices within Mentioned at the time and place within Contained to Shew Cause if anything for himselfe he hath or Knoweth to say why ye within Named Robert Martin should not have Execution against him for the Damages and Costs within Contained &c before Jn.o Doe & Richard Roe good & Lawfull men of my Bailywick as by the within Writt I am Commanded so answers Jos: MccClester Sherr Whereupon the afd James Jones altho' Solemnly Called Comes not nor shews Cause why &c but makes default default &c whereby the said plft remains against the said deft thereof undefended &c Therefore it is Considered by the Justices here the Eighteenth day of August ann Dom one thousand seven hundred & twenty four that the said Robert Martin have his Execution against the said James Jones for as well the sum of five hundred & ten pounds of tobo Certain Damages as also the sum of two hundred & Ninty one pounds of tobo Costs of suite In the Judgmt afd specified as also the sum of two hundred & forty (240) pounds of tobo by the Court here adjudged unto him for his Costs & Damages sustained by occasion of of delay of Execution of the Judgmt afd &c |
