       August Court        1724             224
       afd Joseph Brittingham as of the Rights and Creditts of the said Thomas Brown may be
    Condemned in the hands of the said Joseph Brittingham To satisfie unto the said Richard Holland
    the sum of one thousand pounds of tobacco afd
Therefore it is Considered by the Justices here the Eighteenth day of August ann Dom one thousand
    seven hundred & twenty four that the sum of Nine hundred & Eighteen Pence               part of
    the sum so as afd Confessed be Condemned in the hands of the said Joseph Brittingham as of ye
    Right and Creditts of the said Thomas Brown to satisfy unto the said Richard Holland the
    sum of one thousand pounds of tobo as also all Costs accrewing upon the writt of attachmt
    afd and that the said Richard Holland have his Execution thereof against the said Joseph
    Brittingham according to act of assembly &c
   
    Memorand.m the Garnishee Jno Tull afd with Consent of the plfts attorney voluntaryly takes
    his Oath that he hath none of the Effects of the said Thomas Browns in his hands &c

 This Being an action of trespass upon the Case &c wherein the sherr of
Somersett County to whom the writt in the same action was directed Comes and
makes Return thereof Endorst in these words following viz.t
                                                                                                 Cepi Corpus P Jos: MccClester Sher

       Whereupon the said David John being Called appears and thereupon the said David Johnson
    at the prayer of the plfts attorney is adjudged to give Speciall Bail to the action afd thereupon
    a Certain Tobias Burke of Somersett County Planter present in Court undertakes for the said
    David Johnson that if in Case the said Betty Gale shall Recover Judgm.t in the plea afd against ye
    said David Johnson or that the said David John shall be therein Convict that then he the said David
    Johnson shall pay the Condemnation of the Court thereupon or Render his Body to the Custody of
    the sherr of Somersett County in satisfaction thereof or that he the said Tobias Burke will do it for
    him &c thereupon the said David Johnson by George Dashiell his attorney appears & Imparles
    till next Court &c

 memorandum the plft by Francis Allen his attry sued out his Lordship's writt of
scirefacias against the deft the tenour whereof followeth in these words viz.t
Somersett County fs:  Charles absolute Lord & proprietary of the provinces of Maryland
    and avalon Lord Baron of Baltemore &c to the sherr of Somersett County Greeting Whereas
    a Certain Robert Martin Laty Lately in our County Court of Somersett to witt on the Eighteenth day
    of march in the Eighth Year of Our Dominion &c ann Dom One thousand Seven hundred & twenty
