you Attach any the goods Chattells Rights or Creditts of Thomas Brown of alhollows Parish in the County of Somersett Planter if they shall be found in your Bailywick to the value of one thousand pounds of tobacco and when you have the same attached or any Part thereof the same in your Custody safe Keep so that you have the same Before the Justices of Our County Court to be held at Dividing Creek the third tuesday of August next then and there to be Condemned according to act of assembly to and for the use of a Certain Richard Holland unless the said Thomas Brown by himselfe or his attorney appear and answer unto the said Richard Holland in a plea of trespass upon the Case &c according to Law & that by good & Lawfull men of your Bailywick you make Known unto the person or persons in whose hands you make the same attachm.t that he she or they be and appear before the Justices of Our Said County Court to be held as afd to shew Cause if any he she or they have why the same goods Chattells Rights or Creditts so attached in his her or their hands ought not to be Condemned & Execution thereof had and made according to act of assembly in that Case made and provided if to him her or them it shall seem meet and how you shall Execute this Writt that you make Known unto our ^Justices^ of Our Said Court the 21.st day of June in the Ninth Year of our Dominion &c ann Dom 1724 (F Allen) Thomas Hayward Cler Att which said third tuesday of August to witt Eighteenth day of the same month ann Dom One thousand seven hundred & twenty four being ye Day of the return of the said Writt Cometh the said Richard Holland by his attorney afd and the sher of Somersett County to whom the foregoeing writt was directed Likewise Cometh & make the Return thereof to the Court here Endorst in these words following vizt To the worshipfull Justices within mentioned I humbly Certifie that I have attached in the hands of John Tull the sum of one thousand pounds ^of tobo^ and in the hands of Joseph Brittingham the sum of one thousand pounds of tobacco as the Rights and Creditts of the within Named Thomas Brown and I further Certifie that I have given Notice unto the said John Tull and Joseph Brittingham that they be & appear at the time & place within Contained to shew Cause &c before Mathew Hopkins and Jno Doe good & Lawfull men of my Bailywick on the Eleventh day of August one thousand seven hundred & twenty four as by the within Writt I am Commanded so answers Jos: MccClester Sherr Whereupon the Afd Joseph Brittingham Garnishee of the afd Thomas Brown in his own proper person appears and says that he Cannot gainsay but that he has of the Rights and creditts of the said Thomas Brown in his hands to the value of two thousand pence nor but that the same ought to be Condemned in his hands for the use of the Said Richard Holland as of the rights and Creditts of the said Thomas Brown which ye said plft does not gainsay Whereupon the said Richard Holland by his attorney afd prays that the sum of Nine hundred and Eighteen pen^ce^ part of the sum so as afd Confessed by ye (afd) |
