21 Concerning a Certain Present against her found and that thereof he should not faile &.c Att which said third tuesday of march to witt the Nineteenth day of the same Month Ann Dom one thousand seven hundred and twenty two Comes Being the day of the return of the said Writt Comes the sherr of Sommersett County to whom the foregoeing was directed And makes return thereof Endorst vizt Cepi Jos: MccChester sher Thereupon the Court adjourn'd untill the Last tuesday in aprill being the thirtieth day of the same month Ann Dom One thousand seven hundred and twenty three Att which day the Court Sett against and thereupon Came the said Esther Fluellin and being by the sherr sett to the Barr is thereupon Instantly demanded how she would acquitt herselfe of the Premises above Imposed upon her says that of the Premisses afd she is guilty thereof and submitts to mercy of the Court and makes Oath that a Certain Thomas Rencher is the Begetter of the Child she Stands Presented for and is willing to pay her fine for the fact afd Wherefore the said Esther Fluellen by Consideration of the Justices here is fined to his Lordship the sum of thirty shillings Curr.t mony for the fact afd thereupon she is discharged paying her fine and fees and is ordered to give Security for the Paying the same thereupon her Brother Sam.l Fluellen Present here in Court undertakes for the said Esther Fluellen to pay the fine afd and the severall Officers their fees due by action of the Premisses afd thereupon it is ordered by the Court that the said Esther Fluellen give recognizance in five pounds Curr.t mony for her appearance at the County Court to be held at dividing Creek the third tuesday of June next to give Evidence against the said Thomas Rencher on Behalfe of ye Lord Proprietary and not to depart ye same Court without Lycence thereof &.c Whereupon the said Esther Fluellen acknowledged herselfe to Owe and Stand Justly Indebted unto his Lordship the Lord Proprietary in the sum of five pounds Curr.t mony to be Levied on her Body goods and Chattles Lands and tenements tot eh use of his said Lordship the Lord Proprietary his heirs and successors In Case the said Esther Fluellen do not make her Personall appearance Before the Justices of his Lordships County Court of Sommersett to be held at dividing Creek the third tuesday of June next to give Evidence on Behalfe of his said Lordship against a Certain Thomas Rencher and not to depart ye same Court without Lycence thereof then the above recognizance to be void otherwise to stand and remain in full force and vertue &.c
Allen his attorney Complains that whereas the afd Patrick the sixteenth day of March in the Year of Our Lord God One thousand seven hundred and seventeen at Somrsett County and within the Jurisdiction of this Court was Indebted unto the afd Johannas in the Sum of Six thousand Eight hundred seventy and nine pounds of tobo for sundry Creditts by him given and for meat and drink and one servant woman by the afd same Johannas unto the afd Patrick at the Especiall Instance and request of the same Patrick before that time there sold and delivered as by an acco.t thereof herein Court ready to be Produced may appear and so thereof being Indebted the afd Patrick afterwards to witt the same sixteenth day of march in the (year) |
