212 you or any three or two of you to be Our Commissioners to Examine Evidences on behalf of a Certain John Gunby of Somersett County Gentl: in Relation to the Bounds of a peice of Land Called Middle Ridge We therefore Command and require you or any three or two of you that at some time and place as to you shall or any three or two of you shall seem Convenient you meett on the afd Land Called Middle Ridge and Caus to Come before you or any three or two of you all such Evidences as shall be to you or any three or two of you Nominated by the said Complainant or deft (if any) and that you Examine them or their Corporall oaths to be by you or any three or two of you administred on the holy Evangelist in the presence of the said Complainant touching the truth or remembrance of their Knowledge or anything that may relate to the Caus afd and that reduceing the severall depositions into writing you send the same together with this Our Commission under you or any three or two of your hands to us to Our County Court of Somersett with all Convenient Speed Wittness Joseph Gray Gentl: Chief Justice of Our Said Court the 17.th day of March in the Ninth year of our Dominion &c anno Dom 1723 (p order) Thomas Hayward Cler On the Back of the foregoeing Commission it was thus Endorst viz.t These are to Certifie that Cap.t William Planner and M.r Jeffery Long Came before me the subscriber one of his Lordships Justices of the peace for Somersett County in the province of Maryland and took their oaths on the holy Evangelist of almighty God that that they would truely duely and Impartially Examine all Such Evidences as should be brought before them to give their Evidence Concerning the Bounds of a Certain tract of Land Called Middle ridge as part of assembly in that Case made and provided as witness my hand this 19.th day of March annoq Domini 1723/4 William Stoughton march ye 23 day 1723/4 Then was Sworn Maj.r Isaac Horsey and Thomas Williams according to the foregoeing Oath before me W.m Planner The deposition of John Kellam aged about 43 years or upwards in relating to the first Bounder of a tract of Land surveyed for John Kirke Called Middle ridge bounded by a tract of Land Jno Kellam This deponant being sworn according to the act direction of an act of assembly made at the City of annapolis the twenty third day of September Last declares that M.r John Kirke del tould him in his Lifetime that Beginning Bounder of Middle ridge is a small white oake standing by a Little Swamp near a Marsh about one hundred yards about 20 yards southerly from the orchard on the North Side of a Little ditch and shewed him the tree and tould him ^that^ it was the Bounder Between them as parting their Lands and further saith not as wittness my hand this 14th day of april 1724 John Kellam The deposition of Anthony Bell aged about 66 years or upwards in Relation to a tract of Land surveyed for John Kirke decl Called Middle ridge this deponant being sworn according to that act direction of an act of assembly made at the City of annapolis the 23 day of September Last by ^the^ a great swamp side and north west from thence or there abouts Lies a peice of Clear Land (and) |
