210 afd and Costs of suite of against him which the said plft doth not gainsay &c thereupon Att the prayer of the plfts Prochem Amy and by the Consent of the said defts attorney ^the Just man^ do assess the damages of her the said Sarah by occasion of the premisses afd besides her Costs and Charges according to act of assembly in such Case made and provided to fifty shillings Curr.t mony &c Therefore it is Considered by the Justices here the same day and year Last mentioned that the said Sarah White Recover against the said George Gurley in Custody as afd as well the sum of fifty shillings Curr.t money her damages afd in form afd by the Justices assessed as also the sum of Eight hundred & thirteen pounds of tobacco by the Court here adjudged unto her for her Costs and Charges by her about her suite in this behalfe Laid out and Expended & the deft in mercy &c whereupon the said George Gurley at the prayer of the said Sarah Whites Prochem Amy is by the Court Committed into the Custody of the Sher of Somersett County to be by him in the prison of the County Safely Kept untill the Plft of her damages and Costs afd shall be thereof fully satisfied &c
Instant in the County Court of Somersett the said fifty shillings and Eight hundred and thirteen Pounds of tobacco to be Levied on your Bodys Goods or Chattells Lands or tenements for the use of the said Sarah White in Case ye said George Gurley shall not pay and satisfie to the said Sarah White the said fifty shillings and Eight hundred & thirteen pounds of tobacco so as afd Recovered against her ^with^ the additionall Costs thereon on the tenth day of Novem Next taken W.m Planner Jn.o MccClester June 20.th 1724
unto the said Mary Andrews her heirs Exrs admrs or assignes to the which paym.t well and truly to be made we bind us & Every of us our and Every of our heirs Executors and administrators Joyntly and severally in and for the whole firmly by these presents sealed with our seales and dated the 18.th day of June ann Dom 1724 The Condition of the above Obligation is such that whereas the Commisary Generall hath transmitted into this Court ye acco.t of the Estate of Joseph Stanway dec.d wherein it is found that there is Ballance fo due to the above said (orphan) |
