        Francis Mercer
 Somersett County fs:  Francis Mercer late of Stepney Parish in Somersett
County Mariner was attached to answer unto Thomas Dixson of a plea of
trespass upon the Case &c     And whereupon the same Thomas by Francis Allen
        his attorney Complaines that whereas the afd Francis Mercer the thirtieth day of october in the year
of Our Lord God one thousand seven hundred and twenty at th Somersett County and within the Jur
of this Court was Indebted unto Indebted the afd Thomas in the sum of twelve pounds and two shillings
of Lawfull money of america as by an account thereof hereinto Court ready to be produced may
appear and so thereof being Indebted the afd Francis Mercer afterwards that is to say the same thirtieth
day of October in the year afd at the County afd and within the Jurisdiction afd in Consideration thereof
upon himselfe did assume and unto the afd Thomas then & there faithfully did promise that he ye
afd Francis Mercer the same twelve pounds two shillings money afd ^unto^ and the same Thomas when thereof
afterwards he should be required well and faithfully would pay and Content and altho' the afd Francis Mercer
Nine pounds thirteen shillings pcell of the afd twelve shillings pounds two shillings to the said Thomas
he hath paid and satisfied yett as to two pounds Nine shillings residue of the afd twelve pounds two
shillings the said Francis his promise and assumption afd in form afd made Little regarding but plotting
and fraudulently Intending the same Thomas in this part Craftilly and Subtilly to deceive and defraud
the afd two pounds Nine Shillings or any part thereof unto the same Thomas hath not paid or in
any Sort Contented (altho' to doe the same the afd Francis Mercer afterwards to witt the first day of
may in ye year of Our Lord God One thousand seven hundred and twenty one and often afterwards
at ye County afd in the Jurisdiction afd by the afd Thomas was requested) but that unto him hitherto to
pay or in any wise Content altogether hath refused and still doth refuse to the damage of the
said Thomas of four pounds Eighteen shillings money afd & thereupon he bringeth suite &c

    Whereupon at the prayer of the plfts attorney afd the said Francis Mercer is adjudged to give Sp.ll
bail to the action afd thereupon a Certain Levin Gale of Somersett County Gentl: present here in Court
undertakes for the said Francis Mercer that in Case the said Thomas Dixson shall recover Judgmt in the
plea afd against the said Francis Mercer or that the said Francis Mercer shall be therein Convict that then
he the said Francis Mercer shall pay the Condemnation of the Court thereupon or render his Body to the
Custody of the sherr of Somersett County in satisfaction thereof or that he the said Levin Gale will do it
for him   Whereupon the said Francis Mercer by Levin Gale his attorney Comes & Defends the force
and Injury when &c and says that he Cannot Gainsay the plft his action afd so as afd against him
