208 brought nor Can he say but that the said plft recover his damages by occasion of the premisses afd to two pounds Nine shillings Curr.t money & Costs of Suite against him which the said plft does not Gainsay &c Therefore it is Considered by the Justices here the sixteenth day of June ann Dom One thousand seven hundred & twenty four that the said Thomas Dixson recover against the said Francis Mercer as well the sum of two pounds Nine Shill.s Currt Mony his damages 276 afd in form afd Confessed as also the sum of Two hundred & seventy six pounds of tobacco by the Court here adjudged unto him for his Costs and Charges by him about his suite in this Behalfe Laid Out & Expended & the deft in Mercy &c
James the second day of march ann Dom One thousand seven hundred and twenty two at the parish and County afd within the Jurisdiction of this Court was Indebted unto the said Thomas in five pounds sixteen shillings and Eleven pence ^Currt money of Vergenia of the value of six pounds Eight shilling and Eight pence^ Currt money of maryland for so much by the said Thomas for the said James at the Speciall Instance and request of the said James before that time then and there deposited and paid as by acco.t here in Court ready to be produced may appear and being so thereof Indebted the said James in Consideration thereof the day and year afd at the place afd within the Jurisdiction afd upon himselfe did assume and to the said Thomas then & there did faithfully promise that he the said James the said five pounds sixteen shillings & Eleven pence Curr.t money of Vergenia of the value of six pounds Eight shillings and Eight pence Curr.t silver money of maryland to the said Thomas when he should be thereunto requested he would well and faithfully pay and Content Nevertheless the afd James his promise and assumption afd in form afd made nothing regarding but plotting and fraudulently Intending the said Thomas in that part Craftilly and Subtilly to deceive and defraud the said five pounds sixteen shillings and Eleven pence Curr.t money of Vergenia of the value of six pounds Eight Shill.s and Eight pence Curr.t Silver money of maryland unto the said Thomas altho' the same to do the said James by the said Thomas on the first day of may one thousand seven hundred and twenty three and often afterwards at the County and parish afd within the Jurisdiction afd he was thereunto requested hath not paid or to him for the same in anywise Contented but the same hitherto to him to pay hath refused and still doth refuse and deny whereupon the said Thomas saith he is worse and hath damage to the value of twelve pounds seventeen shillings and four pence Curr.t silver money of Maryland and thereupon he brings suite &c F Allen P Quer Pledged dep Jno Doe R Roe |
