207 against a Certain Adam Hitch of Stepney Parish in the County of Somersett Planter as well the sume of Four hundred and Ninety Nine pounds of tobacco Certain Damages as also the sume of six hundred and twenty seven pounds of tobacco Costs of Suite Whereof he is Convict as by the Record and Process thereof in our said Court Remaining Manifestly appear Notwithstanding Execution of the Judgm.t afd as yett Remaines to be Done as by the Indicnation of the said Ann Jones wee have Received and because we will that those things which in our said Court are Rightly done should be brought to a due Execution Command you that by Good and Lawfull men of your Bailiwick you Make Known unto the said Adam Hitch that he be and appear Before the Justices of Our County Court to be held at Dividing Creek in Somersett County afd the third tuesday of March next to shew Cause if any things for himselfe he hath or Knoweth to say why the said Ann Jones her Execution of the Damages and Costs afd she ought Not to have according to the Law form of the Recover afd if to him it shall seem mete and have you then and there the names of those by whome you Make the same Known and this writt wittness Charles Ballard Gentl Chief Justice of our said Court the 19.th day of December in the Eighth year of Our Dominion &c Ann Dom 1724 Thomas Hayward Clk (Pse) Att which said third tuesday of March to witt the seventeenth day of the same Month Ann Dom One thousand seven hundred and twenty three Being the Day of the returne of the said writt Comes the said Ann Jones by her attorney afd and the sherr of Somersett County to whom the foregoeing writt was made Directed Likewise Comes and Makes Return thereof to the Court hereof Endorst In these words following vizt: Somersett fs To the worshipfull Justices within Mentioned I Humbly Certifie that I have Made Known to the within Mentioned Adam Hitch that he be and appear at the time and Place within Contained to shew Cause &c Before John Doe and Richard Roe Good and Lawfull men of my Bailiwick as by the within writt I am Commanded to answer Jos: MccClester Sherr Whereupon the said Adam Hitch by George Dashiell his attorney Comes and Defends the force and Injury when &c and Prays Leave to Imparle Hereunto untill the next Court and he hath it and the same Day is Given to the Plft also att which said Next Court to witt the sixteenth day of June Ann Dom One thousand seven hundred and twenty four Comes again as well the said Ann Jones by her attorney afd and Prays that the said Adam Hitch to Her writt of sirefacias afd May answer But the said Adam Hitch altho solemnly Called Comes not nor shews Cause why &c But Makes Default Whereby the said Plft Remaines against the said Deft thereof undefended Therefore it is Considered By the Court ^Justices^ here the same day and year Last Poss Mentioned that the said Adam Hitch Ann Jones have her Execution against the afd Adam Hitch for as well the sume of four hundred Ninety Nine pounds of tobacco Certain Damages as also the sume of six Hundred and Twenty seven pounds of tobacco Costs of Suite in the Judgmt afd Specified ^as^ also the sume of 246 Two hundred and forty six pounds of tobacco by the Court here adjudged unto her for her Costs and Damages sustained by occation of Delay of Execution of the Judgmt afd |
