206 ought not to have according to the form of the Recovery afd if to him it shall seem mete and have you then & there the Names of those by whom you make the same Known and this Writt wittness wittness Jos Charles Ballard Gentl Chief Justice of our said Court the 19th day of December in ye Eighth year of our Dominion Ann Dom 1724 Thomas Hayward Clk (G Dashiell) Att which said third tuesday of March to witt Being the seventeenth day of the same Month Ann Dom one thousand seven hundred and thirteen Being the Day of the returne of the said writt Comes the said Merrick Ellis By his Attorney afd & the sherr of Somersett County to whome the foregoeing writt was Directed Likewise Comes and Makes returne thereof to ye Court here Endorst In these words following viz.t To the worshipfull Justices of Somersett County I Humbly Certifie that I have Made Known unto ye within Named Robert Hodge that he ^be^ A & Appear before the Justices within Mentioned at the time and Place within Contained to shew Cause why the within Named Merrick Ellis should not have his Execution against him for the Debt and Costs within Contained Before Mathew Hopkins and John Doe Good and Lawfull Men of my Bailiwick as by the within writt I am Commanded so answers Jos: MccClester Sherr Whereupon the said Robert Hodge By William Tazewell his attorney Comes and Defends the force and Injury when &c and prays Leave to Imparle hereunto untill ye Next Court and he hath it & the same Day is Given to the Plft also Att which said next Court to witt the sixteenth day of June Ann Dom One thousand seven hundred and twenty four Comes again the said Merrick Ellis By his attorney afd and Prays that the said Robert Hodge to his writt of sirefacias afd may answer Butt the said Robert Hodge allthoug sollemnly Called Comes not nor shews Cause why &c But Makes Default whereby the said Plft Remaines against the said Deft thereof undefended Therefore it is Considered by the Justices here the same day and year Last Mentioned that the said Merrick Ellis Have his Execution against the said Robert Hodge fouls well the sume of one thousand one hundred seventy and one pou pounds of tobacco his Debt afd as also the sume of two hundred & Nine pounds of tobacco Costs of suite In the Judgmt afd above specified as also the sume of Two hundred & sixty six 266 pounds of tobacco by the Court here adjudged ^unto him for the Cost and Charges^ sustained by Direction of Delay of Execution of the Judgmt afd &c
wheas a Certain Ann Jones Lately in our County Court of SOmersett to witt on the sixteenth day of March in the Fourth year of Our Dominion &c Ann Dom one thousand seven hundred Ninteen Before the worshipfull Charles Ballard Gentl and his associated the then Justices of our said Court (at Dividing Creek) and by Consideration of our said Court Recovered (against) |
