206 in these words following viz.t Cepi Corpus P Joseph Maclester Sherriffe And the said Timothy Atkinson by Francis Allen his attorney Comes and defends the force and Injury when &c and prays Leave to Imparle hereunto untill the next Court and he hath it and ye same day is given to the plft also &c Att which said next Court to witt the sixteenth day of June Anno Dom one thousand seven hundred and twenty four Comes again the said Timothy Atkinson by this attorney afd and offers himselfe against the said Charles Gresham in the plea afd but the said Charles Gresham altho' solemnly Called Comes not nor is his writt in the plea afd further Prosecuted against the said Timothy Atkinson Therefore it is Considered by the Justices here the same day & year Last mentioned that the said Charles Gresham and his Pledges of Prosecuting be in Mercy &c and Lett the Names of his said Pledges be sought for &c and that the said Timothy Atkinson goe thereof without Day &c also it is Considered by the Justices that the said Timothy Atkinson recover 156 against ye said Charles Gresham the sum of one hundred & fifty six pounds of tobacco by the Court here adjudged unto him for his Costs and Charges by him about his suite defence in this behalfe Laid Out & Expended according to the form of the statute in such Case Lately made & Provided and the afd Timothy have thereof his Exn &c
a Certain Merrick Ellis Lately on our County Court of Somersett to witt on ye sixteenth day of August in the ^sixth^ year of our Dominion Ann Dom one thousand seven hundred and twenty one Before the worshipfull Justices Charles Ballard ^Gentl^ and his associates Justices of our said Court and By Consideration of our said Court at Dividing Creek Recovered against a Certain Robert Hodge of Allhollows Parish in ye County afd Planter as well ye sum of one thousand One hundred seventy & one Pounds of tobacco a Certain Debt as also the sume of two hundred pounds and Ninty Pounds of tobacco by the same Court adjudged to him unto him for his Costs of suite as thereof he is Convict as by ye Record and Process thereof in our said Court Remaining Manifestly appears Nevertheless Execution of the Judgm.t afd as yett remaines to Be done as By the Infirmation of the said Merrick Ellis wee have Received and Because wee will that those things which in our said Court are rightly Done should Be Broughto a due Execution Command you that By Good & Lawfull Men of your Bailiwick you Make Known unto the said Robert Hodge that he Be & appear Before the Justices of our County Court to Be held at Dividing Creek in Somersett County afd the third tuesday of March ^next^ to shew Cause for him self if they he hath to say why the afd Merrick Ellis his Execution afd the Debt & Costs afd he (ought) |
