205 Daniel Cordery, Richard Philips, Giddion Tilman, John Nicholson, John Gillett, George Benston John Murray, Jacob Messick, Thomas Baker, Mercy Fountain who being duly Elected tryed and sworn to say the truth in the premisses upon their oath do say that the said Robert Martin is guilty of the premisses as the said John Paty above ^against him^ hath Complained and do assess the damages of the said John by occasion of the premisses afd to thirty three shillings and four pence &c Wherefore the damages afd found being not within the Jurisdiction of this Court to give Judgm.t on the verdict afd for the plft Therefore it is Considered by the Justices here the sixteenth day of June ann Dom one thousand seven hundred & twenty four that the said John Paty take nothing by his writt & decl.n afd but be in Mercy for his falce Clamour and that the said Robert Martin goe thereof without day &c and also it is Considered by the Justices that the said Robert Martin Recover against the said Jn.o (1964) Paty the sum of Ninteen hundred & Sixty Four pounds of tobo by the Court here adjudged unto him for his Costs and Charges by him about his defence in this behalfe Laid Out & Expended according to the form of the statute in such Case Lately made & provided and the afd robert Martin have thereof his Exn &c
Concerning an assault and Battery by him the said Robert made on a Certain John Paty as appears by a Certain verdict of a Jury that passed between him the said John Paty & the said Rob.t Martin The said Robert Martin present here in Court Confesseth himselfe Guilty of the fact and submitts to the mercy of the Court and is willing to pay his fine for the fact afd &c Therefore it is Considered by the Justices here that the said Robert Martin be fined to his Lordship the Lord proprietary the sum of one hundred pounds of tobacco for the fact afd &c thereupon the said Robert Martin is discharged paying the fine afd & the several officers their fees that accrewed by occasion of the premises afd &c
Cou to be held at Dividing Creek the third tuesday of March then next to answer unto Charles Gresham of a plea of trespass upon the Case &c and that thereof he should not fail &c Att which said third tuesday of march to witt the seventeenth day of the same Month ann Dom one thousand seven hundred & twenty three Com Being the day of the return of the said Writt Cometh the said Charles Gresham by W.m Tazewell his attorney to the sherr of Somersett County to whom the foregoeing writt was directed Likewise Cometh and Maketh return thereof to the Court here Endorst (in) |
