1724 204 Curr.t money and thereof he brings this suite &c L Gale Quer Pledgs &c Jno Doe Richd Roe Jn.o Collins Late of Somersett County dec.d Dr To 32 of Bacon at 6 P £ 16 P Cont Cr To rent of mount hope a year 400 By Ball Due 1300 16 To wintering of 9 head of Cattle & finding fodder & Corn 900 Errors Excepted 8.b 28.th 1723 1300 16 Jurat Incuria Test Thomas Hayward Cler P Thomas Larimore And The said Thomas Ralp and John Collins adm.rs of the same John Collins dec.d by Francis Allen his attry Come and defend the force and Injury when &c and pray Leave to Imparle hereunto untill the next Court & the ^they^ packit and the same day is given to the pflt also Att which said Next Court to witt the seventeenth of march ann Dom one thousand seven hundred and twenty three Come again as well the said plfts as the said deft by their attorneys afd and the said deft.s pray further Leave to Imparle hereunto untill the next Court and they have it & the same day is given to the plft also Att which said next Court to witt the sixteenth day of June ann Dom one thousand seven hundred and twenty four Come again as well the said plft as the said defts by their attorneys afd and the said deft.s by their said attorney as before defends the force & Injury when &c and say that the afd John Collins dec.d in his Lifetime did not assume upon himselfe in Manner and form as the said Thomas Larimore above against them hath Complained and of this they putt themselves upon the Country &c F Allen P Deft bus And the plft in Like manner Levin Gale P plft Thereupon Command is given to the sheriff of Somersett County that Immediately he Cause to Come here twelve &c by whom &c who Neither &c to recognize &c because as well &c of which said preceipt the said sherr to witt Joseph MccClester Gentl: Now here at this day to witt the same day and year Last mentioned makes Return that he has here ready twelve &c as by his preceipt he was Commanded and nowhere afterwards to witt the same day and year Come as ^well^ the said plft as the said defend.ts by their attorneys afd and the Jurors of that Jury Impannelled being Called Come to witt William Handy, Joseph Houston, Daniel Cordery, Giddion Tilman, Richard Philips Adam Hitch, John Scarbrough, John Gillitt, George Benston, Alex.d Maddox, Tho.s Barker, Mercy Fountain who being duely Elected tryed & sworn to the truth in the premisses upon their Oath do say that the said John Collins dec.d in his Lifetime did assume upon himselfe in manner and form as the said Thomas Larimore above against them the said Thos Ralph and John Collins admrs as afd hath Complained and do assess the damages of the said Thomas Larimore by occasion of the premises afd besides his Costs and Charges in this behalfe Laid out and Expended to sixteen shillings Curr.t money and four hundred pounds of tob.o and for his Costs & Charges one pound of tobacco &c Therefore it is Considered by the Justices here the sixteenth day of June ann Dom |
