204 Mentioned by the discretion of the Justices were adjudged the same Thomas Walker the 279 sum of Two hundred & seventy Nine pounds of tobacco for his Costs and Charges Expended according to the form of the statute in such Case thereof Lately made & Provided and the afd Merick Ellis in Mercy and that the afd Thomas Walker have thereof Execution &c
And whereupon the same Thomas Larimore by Levin Gale his attorney Complaines that whereas the afd John Collens Decds in his Lifetime that is to say the tenth Day of June One thousand seven hundred & twenty two at ye County afd within the Jur of this Court was Indebted unto the afd Thomas Larimore in the sum of sixteen shillings Currant Mony of Maryland and thirteen Hundred pounds of Tobacco as By acctt here within Court Produced May Appear and so thereof Being Indebted the same John Collins Decd in His Lifetime afterward that is to say the same Day year & Place afd within the afd Jurisdiction in Consideration thereof upon Himselfe assumed and to the same Thomas Larimore then and there then and there faithfully Promised that he when afterwards he should Be thereto Requested the afd sum of sixteen shillings and thirteen Hundred pounds of Tobacco to ye same Thomas He would well and faithfully Content and pay Nevertheless the afd John Collins Decd in his Lifetime and the afd John Collins and Thomas Ralph His Admin.rs since his Death the Promise and Assumption afd of the afd John Collins Deceased In his Lifetime so as afd Made Little Regarding and plotting fraudulently Intending the afd Thomas Larimore in that Part to Defraud and Deceive Neither the afd John Collins Deceased in his Lifetime Nor the afd John and Thomas his administrators since his Death the afd sum of sixteen shillings Curr.t ^money^ as afd and thirteen hundred pounds of tobacco or any part thereof to the said Thomas Larimore (altho' the same John Collins dec.d in his Lifetime afterwards that is to say the tenth day of July One thousand seven hundred and twenty two and the afd John Collins and Thomas Ralph his administrators since his death that is to say the tenth day of June one thousand seven hundred & twenty three at the County afd within the Jurisdiction afd was thereunto Requested) hath not paid or Contented but they & Every of them the same hitherto to the same to pay Thomas to pay or in anywise to Content have altogether Refused and still do refuse whereupon the Same Thomas says he is worse and hath damage to the value of twenty six ^hundred^ pounds of tobacco and one ^pound^ twelve Shillings Curr.t |
