203 a Certain Samuel Marchament of Somersett County Cryer Planter present in Court undertakes for the said Edward Peacock that in Case the said George Lane shall recover Judgmt in the plea afd against the said Edward Peacock or that the said Edward peacock shall be therein Convict that then he the said Edward Peacock shall pay the Condemnation of the Court thereupon or render his Body to the Custody of the sherr of Somersett County in satisfaction thereof or that he the said Samuel Merchament will do it for him Whereupon the said Edward Peacock in his own proper person Comes and defend the force & Injury when &c and says that he Cannot gainsay the plft his action afd so as afd ag.t him brought nor Can he say but that the said plft ought to recover his damages by occasion of the premisses afd to Eighty Bushells of Indian Corn and Costs of Suite against him which the said plft doth not gainsay &c Therefore it is Considered by the Justices here the sixteenth day of June ann Don One thousand Seven hundred and twenty four that the said George Lane recover against the said Edward Peacock as well the sume of Eighty Bushells of Indian Corn his damages (310) afd in form afd Confessed as also the sum of Three hundred & Tenn pounds of tobacco by the Court here adjudged unto him for his Costs and Charges by him about his suite in this Behalfe Laid Out & Expended & the deft in Mercy &c
ann Dom seventeen hundred and twenty at the parish and County afd within the Jurisdiction of this Court with force and armes &c a Certain Dogg of the price of ten pounds Curr.t money of his the said Mericks then and there being found then and there did take hang and Choak by reason whereof the dogg afd Instantly did dye and other harmes to the said Ellis then and there did do against ye Peace &c and to the Damage of the same Merick twenty pounds Currt mony and thereof he brings suite &c Tazewell P Quer pledges &c Jno Doe R Roe And the said Thomas Walker by Francis Allen his attorney Comes & Defends the force & Injury when &c And prays Leave to Imparle hereunto untill the Next Court and he hath it and the same day is given to the plft also Att which said next Court to witt the seventeenth day of March anno Dom one thousand seven hundred & twenty three Come again as well the said plft as the said deft by their attorneys afd and the said deft by his said attorney prays further Leave to Imparle hereunto untill the next Court and he hath it and the same day is given to the plft also Att which said next Court to witt the sixteenth day of June anno Dom one thousand seven hundred and twenty four Comes again As well the said plft as the said deft by their attorneys afd and the afd plft then and there his action afd against ye afd deft did not prosecute with Effect but voluntarily suffered his suite to be discontinued &c therefore afterwards the same day & year Last (Mentioned) |
