203 Lawfull men of my Bailywick as by the within Writt I am Commanded so answers Jos: MccClester Sherr Whereupon the said Joseph Shipping & Rose his wife Exrx of the same John MccWilliams by their attorney afd pray that the said Francis Hamblin to their Writt of scirefacias afd may answer But the said Francis Hamblin altho' solemnly Called Comes not nor shews Cause why &c but makes default whereby the said plfts remain against the said deft thereof undefended &c Therefore it is Considered by the Justices here the sixteenth day of June ann Dom One thousand seven hundred and twenty four afd that the said Joseph Shipping and Rose his wife Executrix of the same John MccWillams have their Execution against the said Francis Hamblin for as well the sum of seven hundred & forty ^pounds tobo^ debt afd as also the sum of two hundred and fifty six pounds of tobacco & Costs of suite in the Judgmt afd specified as also the sum of Two (240) hundred & forty pounds of tobacco by the Court here adjudged unto them for their Costs and damages sustained by occasion of Delay of Execution of the Judgm.t afd
Dom one thousand seven hundred and twenty three at the Parish and County afd within the Jurisdiction of this Court was indebted unto the said George in Eighty Bushells of Indian Corn as by a Certain note by the said Edward signed ready herein Court to be produced may appear and being so thereof indebted ye said Edward in Consideration thereof the day and year afd at the place afd within the Jurisdiction afd upon himselfe did assume and to the said George then and there did faithfully promise that he the said Edward the said Eighty Bushells of Indian Corn to the said George at the Landing of M.r William White on the tenth day of November then next he would well and faithfully pay and Content Nevertherless the said Edward his promise and assumption afd in form afd made nothing regarding but plotting and fraudulently Intending the said George in that part Craftilly and subtilly to deceive and defraud the said Eighty Bushells of Indian Corn to the said George on ye afd tenth day of October afd at the place afd altho' the same to do the said Edward by the said George on ye afd tenth day of October and often afterwards at the place afd within the Jurisdiction afd he was thereunto requested hath not paid or to him for the same in anywise Contented but ye same to him hitherto to pay or in any sort for ye same to Content hath altogether refused and still doth refuse and deny whereupon the said George saith he is worse and hath damage to the value of three thousand pounds of tobacco & thereupon he Brings Suite &c F Allen P Quer Pledges dep Jno Doe Ricd Roe Whereupon the said Edward Peacock appears & thereupon ye said Edward Peacock at ye prayer afd plfts attorney afd is adjudged to give Speciall Bail to the action afd thereupon (a Certain) |
