202 Somersett County fs: Charles absolute Lord and proprietary of the provinces of maryland and avalon Lord Baron of Baltemore &c To the sherr of Somersett County Greeting Whereas a Certain John M.ccWilliams Lately in our County Court of Somersett (to witt) on the twentieth day of June in the third year of our Dominion &c Ann Dom One thousand seven hundred & seventeen by me the the worshipfull Charles Ballard and his associates ^the^ Justices of our said Court at Dividing Creek and by Consideration of our Said Court Recovered against a Certain Francis Hambling of all hollows Parish in the County afd Planter as well the sum of seven hundred and forty pounds of tobacco a Certain Debt as also the sum of two hundred and fifty six pounds of tobacco Costs of suite Laid out & Expended whereof he is Convict as by the record & Process thereof in our said Court Remaining manifestly appears and afterwards (that is to say) the said John MccWilliams at Somersett County made his last will and Testament in writing and by the same Constituted and ordained Rose his wife Executrix of his testament afd and there dyed afterwards the said Rose Ex.rx as afd Intermarried with a Certain Joseph Shipping as by the Insinuation of the said Joseph wee have Ex.d and altho' Judgm.t be thereupon rendered Nevertheless Execution for the Debt and Costs afd as Yett remains to be done Whereupon the said Joseph Shipping and Rose his wife Exrx of the afd John MccWilliams hath supplicated to as to provide them a fitt remedy in this Behalfe and we being willing that those things which in our said Court are Rightly done should be brought to a due Execution Command you that by good and Lawfull men of your Bailywick you make Known unto the said Francis Hambling that he be and appear before the Justices of our County Court to be held at Dividing Creek in Somersett County afd the third tuesday of June next to shew Cause if any thing for himselfe he hath or Knoweth to say why the said Joseph Shippin and Rose his wife Exrx as afd ought not to have their Ex.n of the debt and Costs afd against the said Francis Hambling according to the form force and Effect of the recovery afd if to him it shall seem m^e^et and further to do and receive that which our said Court shall Consider of and have you then & there the Names of those by whom you make ye same Known and this writt Wittness Joseph Gray Gent: Cheife Justice of our said Court ye 29.th day of may in the 9.th year of our Dominion &c ann Dom 1724 Att which said third tuesday of June to witt the sixteenth day of the same Month ann Dom one thousand seven hundred & twenty four Being the day of the return of the said Writt Cometh the said Joseph Shipping and Rose his wife Exrx as afd by Fra their attorney afd and the sherr of Somersett County to whom the foregoeing writt was directed Likewise Cometh & make the return thereof to the Court here Endorsed in these words following viz.t To the Worshipfull Justices of Somersett County I humbly Certifie that I have made Known unto the within Named Francis Hambling that he be and appear before the Justices within Mentioned at the time & place within Contained to shew Cause why the within Named Joseph Shipping should not have his Execution against him for ye Debt and Costs within Contained before Mathew Hopkins & Jno Doe good and (Lawfull) (F Allen) Thomas Hayward Cler |
