201 by Levin Gale his attorney Complaines that whereas the afd Benjamin the tenth day of December one thousand seven hundred and twenty three at the County afd within the Jurisdiction of this Court was Indebted to the said William Clark in the sum of forty five shillings Curr.t money for a Certain hand Gun to the same Benj.a Before that time at his Especiall Instance & request by the same William sold and deliver'd and so thereof being Indebted the same Benj.a in Consideration thereof afterwards that is to Say the afd tenth day of December in the Year afd at the County afd within the Jurisdiction afd upon himselfe assumed and to the same William then and there faithfully promised that he the said Benjamin when afterwards he should be thereunto requested by the said William the afd sum of forty five shillings Curr.t money to the afd William the afd he would well and faithfully Content and pay Nevertheless the afd Benj.a his promise and assumption afd in form afd made Little Regarding but plotting and fraudulently Intending the afd William in that part Craftilly and Subtilly to defraud & Deceive the afd Benjamin the afd sum of forty five shillings Curr.t money or any part thereof to the afd William altho' the afd Benjamin afterwards that is to say the thirtieth day of December one thousand seven hundred and twenty three at the County afd within the Jurisdiction afd was by the said William thereunto Requested hath not paid or to him for it in anywise Contented but the same Benjamin the same to the said William Clark hitherto to pay or anyway to Content hath altogether refused and still doth refuse whereby the same William says he is the worse and hath damage to the value of four pounds ten shillings Curr.t money of maryland & thereof he Brings this suite &c L Gale P Quer pledges &c Jno Doe Richd Roe A Copy of the foregoeing declaration was made and sent to be serv'd on the deft with ye writt in ye Plea afd Att which said third tuesday of June to witt the sixteenth day of the same Month ann Dom one thousand seven hundred & twenty four Being the day of the return of the said Writt Comes the said William Clark by his attorney afd and the sherr of Somersett County to whom the foregoeing writt was directed Likewise Comes & makes Return thereof to the Court here Endorst in these words following viz.t Cepi Corpus decl.n delivered in time P Jos: MccClester sher Whereupon at the prayer of the Plfts attorney afd is adjudged the said Benjamin King is adjudged to give Speciall Bail to the action afd thereupon a Certain Capell King of Somersett County Gentl: present here in Court undertakes for the said Benjamin King that if in Case the said William Clark shall recover Judgmt in the plea afd against the Said Benjamin King or that ye said Benjamin King shall be therein Convict that then he the said Benjamin King shall pay the Condemnation of the Court thereupon or render his Body to the Custody of the sherr of Somersett County afd P or In satisfaction thereof or that he the said Capell King will doe it for him Whereupon the said Benj.a King by ^Geor: Dashiell^ his attorney Comes and defends the force and Injury when &c and the afd W.m Clark by his attorney afd prays |
