1724 200 A Copy of the foregoeing declaration was made and sent with the writt in the plea afd Att which said third tuesday of June to witt the sixteenth day of the same month ann Dom one thousand seven hundred & twenty four Being the day of the return of the said Writt Comes the said John Banister by his attorney afd and the sherr of Somersett County to whom the foregoeing writt was directed Likewise Comes and makes Return thereof to the Court here Endorst in these words vizt Cepi Corpus P Jos: MccClester Sherr Whereupon the said Alexander Carlyle by Francis Allen his attorney Comes and defends the force and Injury when &c and saith that he did not assume upon himselfe in Manner & form as the said John above against him hath Complained & of this he putts himselfe upon the Country &c F Allen P Deft And the Plft in Like manner L Gale P Quer Thereupon Command is given to the sherr of Somersett County that Immediately he Cause to Come here twelve &c by whom &c who Neither &c to Recognize &c because as well &c of which said preceipt the said sherr to witt Joseph MccClester Gentl: Now hereat this day to witt the same day and year Last mentioned make Return that he hath here Ready twelve &c as by his preceipt he was Commanded and Now hereafterwards to Witt the same day and year Comes as well the said Plft as the said deft by their attorneys afd and the Jurors of that Jury therein Impanned being Called Came to witt William Handy, Joseph Houston, Daniel Cordery, Giddion Tilman, Richard Phillips, William Fountain William Hopkins, John Scarbrough, John Gillett ,George Benston, Alex.d Maddux, Mercy Fountain who being duly Elected tryed & sworn to say the truth in the premisses upon their Oath do say that the said Alexander Carlyle did assume upon himselfe in manner and form as the said John Banister above ag.t him hath Complained and do assess the damages of the said John besides his Costs and Charges to four hundred and fifty Nine pounds of tobacco and for his Costs and Cha^r^ges one pounds of tobo Therefore it is Considered by the Justices here the sixteenth day of June ann Dom one thousand seven hundred & twenty four that the said ^John Banister^ John Bannister Recover against the said Alexander Carlyle as well the sum of four hundred and fifty Nine pounds of tobo his damages afd by the Jurors afd in form (1378) afd assessed as also the sum of one thirteen hundred seventy Eight pounds of tobo by the Court here of his assent of Increase adjudged for his Costs and Charges by him about his suite in this Behalfe Laid out Expended & the deft in Mercy &c
William Clark of a plea of trespass upon the Case &c and that thereof the should not fail &c And the said William Clark by Levin Gale ^his attorney^ Proceeded against the said William Clark in the plea afd as followeth viz.t Somersett fs Benjamin King late of Somersett County planter was attached to answer unto William Clark of a plea of trespass upon the Case &c And whereupon the same William Clark (by) |
